In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, November 13, 2006, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

Known as being a part of Lot #27, Rootstown Township, Portage County, Ohio, bounded and described as follows:

Beginning for reference at a 1 inch iron bar found in a monument box, said bar being 15 inches below the street surface, also being the intersection of the center lines of Bower Road (T.H. 104-A) and Kline Street (T.H. 103-A), also being the Southwest corner of Lot #27, Rootstown Township, Portage County, Ohio; thence proceeding South 84 deg. 50 minutes 48' East along the center line of Bower Road and being the South lot line of Lot #27, Rootstown Township, a distance of 2785.98 feet to a railroad spike set flush to the street surface and being the true place of beginning of the tract herein described; thence proceeding North 3 deg. 56' 37" seconds East, a distance of 1838.07 feet to a 5/8 inch iron bar set flush to the ground and being on the South line of a 23.45 acre tract now or formerly owned by G. Ward as recorded in Deed Volume 574, Page 171 of the Portage County Recorder's Office, also passing over a 5.8 inch iron bar set flush to the ground 30.00 feet from said center and lot line; thence proceeding South 85 deg. 88' 53" East, along said Ward lands a distance of 872.01 feet to a 1/2 inch iron pipe found 10 inches above the ground surface on the East line of Lot #27, being the Southeast corner of G. Ward 25.65 acre tract; thence proceeding South 03 deg. 45' 57" West, along said East lot line a distance of 947.35 feet to a 2 inch iron pipe found 15 inches above the ground surface and being the Northeast corner of a landlocked tract hereby incorporated into the above described tract, said landlocked tract being recorded in Deed Volume 1023, Page 242 in the name of John Baber; thence continuing South 03 deg. 45' 37" West, along said East lot line a distance of 274.46 feet to a 5/8 inch iron bar set flush to the ground surface and being the Northeast corner of a 4.00 acre tract now or formerly owned by Mary Baber as recorded in Deed Volume 964; thence proceeding North 86 deg. 21' 45" West along said Baber tract, a distance of 428.28 feet to a 1 inch pinch top pipe found 4 inches above the ground surface, being the Northwest corner of said Baber tract; thence proceeding North 3 deg. 56' 19" East, along the lands now or formerly owned by D. or G. Kelly Deed Volume 999, Page 678, a distance of 274.47 feet to a 1/2 inch pipe found 5 inches above the ground surface and being the Northeast corner of said Kelly Tract; thence proceeding North 85 deg. 47' 06" West along said Kelly tract and along the tract now or formerly owned by J. & S. Eldreth, Deed Volume 897, Page 185, a distance of 396.00 feet to a 5/8 inch iron bar set flush to the ground and being the Northwest corner of the Eldreth tract; thence proceeding South 03 deg. 56' 57" West and parallel with above said West property line and along said Eldreth lands, a distance of 883.75 feet to a railroad spike set flush to the above said street surface being on said center and South lot line and passing over a 5/8 inch iron bar set flush to the ground 30.00 feet from said center and lot line; thence North 84 deg. 50' 48" West, along said center and South lot line, a distance of 50.00 feet to the true place of beginning of the tract herein described. Containing 22.812 acres of land as surveyed by N. C. Nichols on May 7, 1985 #5586.

Said Premises Appraised at $250,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
