In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, October 2, 2006, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Windham to-wit:

PARCEL ONE:

Situated in the Township of Windham, county and state aforesaid and known as being a part of Lot 80, bounded and described as follows:

Commencing in the center of the townline road between Braceville and Windham, which is the East line of Lot 80 and at the Southeast corner of lands of this Grantor, said point being at the Northeast corner of land formerly owned by Hiram Lane, and running thence Westerly along the lands of said Hiram Lane, 200 feet to a point; thence North and parallel to the lot line 100 feet; thence East and parallel to the first course therein, 200 feet to the lot line in the center of the highway; thence South on said lot line, 100 feet to the place of beginning and containing within said bound 0.46 acres of land, be the same more or less, but subject to all legal highways.

PARCEL TWO:

Situated in the township, county and state aforesaid and known as being a part of Lot 80 in said Windham Township, and bounded and described as follows:

Beginning in the center of the townline road between Windham and Braceville which is the East line of said Lot 80 at a point 397 feet North of the South line of said Lot 80 and running thence West along land now or recently owned by E. A. McGuire, 200 feet; thence South 100 feet to land formerly owned by Thomas E. Shank; thence West along said Thomas E. Shank's land, 138.25 feet to a post; thence N. 0 deg. 15' West, 257.56 feet to a stake; thence East 338.25 feet to the center of the townline road and the East line of the lot; thence S. 0 deg. 15' East on the lot line in the center of the road, 157.56 feet to the place of beginning and containing 1.54 acres of land, as surveyed by C. R. Peppeard, be the same more or less, but subject to all legal highways.

Said Premises Located at 9495 Shanks Down Rd., Windham, OH 44288.

Said Premises Appraised at $125,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.

THE OWNER IS ALSO RESPONSIBLE FOR KNOWING EXACTLY WHAT HE IS PURCHASING.
