In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, September 11, 2006, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Atwater to-wit:

Also being part of Original Township Lot 125 and being more fully described as follows:

Beginning at a 0.5" iron rod found at the Southeast corner of Lot 125, said iron rod also being at the centerline intersection of Stroup Rd., C.H. 50 (60 ft. wide) and Moff Rd., T.H. 51 (40 ft. wide); thence N. 00 deg. E., 2053.76 ft. along the East line of Lot 125 and the centerline of Stroup Rd. and passing over a railroad spike set at 1723.76 ft. to a point, said point also being the true point of beginning for the parcel of land herein described; thence S. 89 deg. 29' 58" W., 1214.56 ft., and passing over a 0.625" capped rebar set at 30 ft. to a 0.625" capped rebar set on the Easterly right of way of Conrail Railroad (formerly the C and P Railroad); thence N. 22 deg. 15' 7" W., 177.64 ft. along the Easterly right of way of Conrail to a 0.625" capped rebar set; thence N. 89 deg. 29' 58" E., 1281.83 ft. and passing over a 0.625" capped rebar set at 1251.63 ft. to a point on the East line of Lot 125 and the centerline of Stroup Rd.; thence S. 00 deg. E., 165 ft. along the East line of Lot 125 and the centerline of Stroup Rd. to the point of beginning, containing 4.729 acres of land, more or less, as surveyed by Dan Stankavich, Professional Surveyor No. 7122, on July 10, 1995, Parcel No. 01-055-00-00-005-004

Said Premises Located at 2169 Stroup Rd., Atwater, OH 44201.

Said Premises Appraised at $225,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
