In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, September 11, 2006, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

PARCEL 1:

Situated in the Township of Randolph, County of Portage and State of Ohio:

Known as being part of Lot No. 85 in said township, bounded by beginning at the center of Randolph-Ravenna Road at the North boundary of land owned by W. A. Hankey, now owned by Chalmers; thence Easterly along said boundary line 20 rods; thence North to land formerly owned by George Ladd, now owned by McGrath, et al., 8 rods on a line parallel with the centerline of the road; thence West on a line parallel to the South line 20 rods to the center of the road; thence South along the centerline of the road 8 rods to the place of beginning and containing one acre of land.

PARCEL 2:

Situated in the Township of Randolph, County of Portage and State of Ohio:

Known as being part of Lot 85 in said township and further described as:

Beginning at a point in the center line of S.R. 44 and at the Northwest corner of lands now owned by Wilbur A. Hankey, et al., said point being North about 1099.56 ft. along the center of S.R. 44 from the Southwest corner of Lot 85, the true place of beginning for this description; thence East along the North line of said Hankey's land being also the South line of a one-acre parcel owned by Roger Begue and Agnew Begue, a total distance of 330 feet to an iron pin marking the Southeast corner of the said one-acre parcel owned by the said Roger and Anges Begue (passing over an iron pin 28 feet from the center of highway); thence South and parallel to the center line of S.R. 44, a distance of 125.00 feet to an iron pipe; thence West and parallel to the South line of the one-acre parcel owned by the said Roger and Agnes Begue for a distance of 330 feet to the center line of said S.R. 44, again passing over an iron pipe 28 feet from center of highway; thence North along the center line of S.R. 44, a distance of 125 feet to the place of beginning and containing 0.947 acres of land as surveyed by Marvin F. Stevens, Reg. Surveyor No. 260.

Said Premises Located at 2270 State Route 44, Atwater, OH 44201.

Said Premises Appraised at $115,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
