In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, August 7, 2006, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Kent to-wit:

Situated in the City of Kent, County of Summit and State of Ohio:

And known as being Lot Number 20 in the John J. McKinney Allotment, as recorded in Volume 12, Page 46, Portage County Records of Plats.

LESS AND EXCEPTING THE FOLLOWING:

Situated in the City of Kent, County of Portage and State of Ohio and known as being part of Original Franklin Township Lot No. 44 and further being part of Sub Lot No. 20 in the John J. McKinney Allotment as the same is recorded in Portage County Plat Book 12, Page 46 and is further described as follows:

Beginning at an iron rod found in a monument box assembly in the centerline of McKinney Boulevard 50' wide, at its intersection with the centerline of Hudson Road, 60' wide; thence along the centerline McKinney Boulevard S. 89 deg. 41' 00" W., a distance of 1957.82 feet to a point in the center of a cul-de-sac at the West end of McKinney Boulevard as appears on said plat; thence S. 04 deg. 52' 30" E., a distance of 75.00 feet to an iron rod set in a curve and the true place of beginning for this parcel of land; thence S. 00 deg. 19' 00" E., a distance of 113.02 feet to a point being also situated at the Northeast corner of Sub Lot No. 1 in the Brookside Farms Estates as the same is recorded in Portage County Plat Book 24, Pages 53-54; an iron pipe was found N. 57 deg. 03' 00" E., a distance of 0.33 feet from said point; thence along the Southerly line of said Sub Lot No. 20, S. 89 deg. 41' 00" W., a distance of 101.91 feet to a point in the Southwest corner of said Sub Lot 20; thence along the Westerly line of said Sub Lot No. 20, N. 13 deg. 01' 33" W., a distance of 192.49 feet to a point at the Northwest corner of said Sub Lot 20; thence N. 89 deg. 41' 00" E., a distance of 63.30 feet to a point in a curve in the cul-de-sac at the West end of McKinney Boulevard as appears on said plat; thence Southeasterly along the arc of a curve deflecting to the left a distance of 123.78 feet to the true place of beginning; said curve has a radius of 75.00 feet, a central angle of 94 deg. 33' 30", and a chord distance of 110.20 feet which bears S. 47 deg. 35' 45" E. and found to contain 0.41891 acres of land be the same more or less as surveyed and described in May, 2001 by Don Trocchio Registered Surveyor No. 644. Bearing are grid North NAD83 Ohio State Plane Rectangular Coordinates, North Zone.

Said Premises Appraised at $115,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
