In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, April 24, 2006, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

PARCEL NO. 1:

Situated in the Township of Randolph, County of Portage and the State of Ohio:

And known as being part of Lot 53 of said township, and bounded and described as follows:

Beginning at a stone set at the Northeast corner of Lot No. 53, and in the center line of C.H. No. 31, New Milford Road; thence South 1 deg. 15' East along the center line of said road, which line is also the East line of Lot No. 53, a distance of 917.79 feet to a point of the true place of beginning; thence South 1 deg. 15' East along the center line of aforementioned road, which is also the East line of Lot No. 53, a distance of 229.21 feet to a point; thence South 88 deg. 30' West passing over an iron pipe set 30 feet from the center of said road a distance of 190.00 feet to an iron pin; thence North 1 deg. 15' West 229.21 feet to an iron pin; thence North 88 deg. 30 East feet passing over an iron pin set 30 feet from center line of C.H. No. 31, New Milford Road, a distance of 190.00 feet to the true place of beginning, and containing one (1) acre of land, be the same more or less, but subject to all legal highways.

Situated in the Township of Randolph, County of Portage and State of Ohio, Town 1 North, Range 8 West and known as being part of Township Lot 53 and being further bounded and described as follows:

Commencing at the Northeast corner of Lot No. 53; thence South 05 deg. 58 min. 30 sec. West, along the existing centerline of New Milford Road (County Highway 31); 1,144.00 feet to a point; thence North 85 deg. 44 min. 30 sec. West along the Southwesterly property line of Doyce F. Decker, Jr., and Susan E. Decker, as recored in Volume 899, Page 498 of Portage County Records and the Northerly property line of L. J. Harris and L. A. Harris, as recorded in Volume 740, Page 274, Portage County Records, 190.00 feet to a point said point is marked by an iron pin and being the Grantor's Southeast property corner and the principal place of beginning; thence continuing North 85 deg. 44 min. 30 sec. West, along the Grantor's Southerly property line and the Northerly property line of L. J. Harris and L. A. Harris, 328.00 feet to a point marked by an iron pin; thence North 05 deg. 50 min. 00 sec. East, along the Grantor's Westerly property line and the Easterly property line of Phillip W. Kelley and Welds M. Kelley, as recorded in Volume 910, Page 752, Portage County Records, 182.36 feet to a point marked by an iron pin in the existing Southerly limited access right of way line of U.S.R. 224; thence North 86 deg. 09 min. 50 sec. East, along the existing Southerly right of way line of U.S.R. 224, and the Grantor's Northerly property line, 332.60 feet to a point marked by an iron pin; thence South 05 deg. 50 min. 00 sec. West, along the Grantor's Easterly property line and the Westerly property line of Doyce F. Decker, Jr. and Susan E. Decker, 229.21 feet to the principal place of beginning, containing within said bounds 1.549 acres of land, be the same more or less, but subject to all legal highways. Based on a survey made by Floyd L. Thomas, Registered Surveyor No. 5461.

Said Premises Located at 1511 New Milford Rd., Atwater, OH 44201.

Said Premises Appraised at $115,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
