In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, March 6, 2006, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Palmyra to-wit:

Situated in the Township of Palmyra, County of Portage and State of Ohio:

And known as being part of Lot 23, Division 4 in said township and bounded and described as follows:

Beginning at a point in the Northerly line of Palmyra Township at the intersection of the Northeasterly corner of said Lot 23, Division 4, and the centerline of C.H. 120, Cable Line Road and C.H. 135, McClintocksburg Road; thence South along the Easterly line of said Lot 23 and centerline of C.H. 135, a distance of 1676.14 feet to a point at a Northeasterly corner of land now or formerly owned by W. & D. Kirschner (Vol. 704, Page 150) which marks the true place of beginning for the following described parcel of land; thence S. 89 deg. 58' 52" W. (passing over a 1/2" iron pipe found at 33.28 feet) a distance of 1036.57 feet to a 1/2" iron pipe found in an Easterly line of said Kirschner; thence N. 00 deg. 02' 21" W., along said Easterly line of Kirschner a distance of 210.11 feet to a 1/2" iron rod set; thence N. 89 deg. 58' 52" E. (passing over a 1/2" iron rod set at 1006.71 feet) a distance of 1036.71 feet to a point in the Easterly line of Lot 23, Division 4 and the centerline of C.H. 135; thence South along the Easterly line of said Lot 23 and centerline of C.H. 135, a distance of 210.11 feet to the true place of beginning, containing 5.000 acres of land, more or less, as surveyed October 1, 1987 by Al Szuch & Associates, Registered Surveyor No. 5398.

Said Premises Located at 5125 McClintocksburg Rd., Newton Falls, OH 44444.

Said Premises Appraised at $140,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
