In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, January 23, 2006, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

Situated in the Township of Randolph, County of Portage and State of Ohio:

And known as being part of Lot No. 91 in said township, bounded and described as follows:

On the East by lands now owned by E. S. & R. L. Darrah; on the South by lands now owned by K. R. Luperi and by the lands H. & R. Sprangler; on the West by the West line of Lot 91, and on the North by the North line of Lot 91, being also the North line of Randolph Township and the centerline of the East and West highway, known as T.H. 116 Wilkes Road, and containing 12.50 acres of land, be the same more or less, but subject to all legal highways.

Excepting therefrom the following:

Situated in the Township of Randolph, County of Portage, State of Ohio, and known as being part of Lot 91 of said township and further described as follows:

Beginning at a centerline of intersection of Sanford Road T.H. 108 and Wilkes Road T.H. 116; thence S. 89 deg.-46'-40" E., a distance of 1287.67' along the centerline of Wilkes Rd. to a point which is the true place of beginning; thence continuing S. 89-46'-40" E., a distance of 184.20' along the said centerline to a point; thence S. 0 deg.-40'-20" E., a distance of 827.94' along the Westerly line of property owned by E. S. or R. L. Darrah to an I.P. and passing over an I.P. at 30.00'; thence N. 89 deg.-38'-18" W., a distance of 184.21' along the Northerly lines of property owned by D. D. & H. Hostetler and R. M. Lupori to a point; thence N. 0 deg.-40'-20" W., passing over an I.P. at 797.49' a total distance of 827.49' to the true place of beginning and containing 3.500 acres of land, more or less, as surveyed by Edward P. Wanchick, Registered Surveyor No. 5756.

Line pins were set 250/back from centerline on the above East and West lines.

Said Premises Located at 5214 Wilkes Rd., Atwater, OH 44201.

Said Premises Appraised at $120,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
