In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, November 21, 2005, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Freedom to-wit:

Situated in the Township of Freedom, County of Portage and State of Ohio and begin a parcel of land located in Lot 53, Freedom Township, Portage County, State of Ohio and being further described as follows:

Commencing at a point on the centerline of SR 700 Freedom-Burton Road with its intersection of the Southerly line of Lot 53, said point being referenced by an iron pin found South 89 degrees 56' West, a distance of 30.36 feet and an iron pin found North 89 degrees 56' East, a distance of 30.36 feet; thence North 8 degrees 44' 56" East, along the centerline of SR 700 Freedom-Burton Road, a distance of 779.09 feet to a road nail set on said centerline, said point being the true place of beginning for this survey; thence South 89 degrees 56' West, along a line running through the Grantors property and passing over an iron pin set at 30.36 feet, a distance of 995.16 feet to an iron pin set on said line, said point being on the Easterly property line of land now or formerly owned by GR Brookover; thence North 0 degrees 06' 20" West, along the Easterly property line of land now or formerly owned by GR Brookover, a distance of 98.82 feet to an iron pin set on said property line; thence North 89 degrees 56' East, along a line running through the Grantors property, and passing over an iron pin set 30.36 feet from the centerline of SR 700 Freedom-Burton Road, a distance of 1,010.55 feet to a road nail set on said centerline; thence South 8 degrees 44' 56" West, along the centerline of SR 700 Freedom-Burton Road, a distance of 100.00 feet to the true place of beginning for this survey and containing 2.275 acres of land as surveyed in October 1994 by Floyd L. Thomas and Samuel C. Janka, Registered Surveyors No. 5461 and 5739 of the State of Ohio, be the same more or less, but subject to all legal highways.

Said Premises Located at 9623 State Route 700, Windham, Ohio 44288.

Said Premises Appraised at $90,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.

THE OWNER IS ALSO RESPONSIBLE FOR KNOWING EXACTLY WHAT HE IS PURCHASING.
