In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, October 31, 2005, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Palmyra to-wit:

Situated in the State of Ohio, County of Portage, Township of Palmyra and being a part of Lot 29, Division 3 of said Palmyra Township and being further bounded described as follows:

Beginning at the point of intersection of the centerline of Jones Road, C.H. 136 (60 feet in width) with the centerline of Tallmadge Road, C.H. 18 (66 feet in width); thence N. 89 degrees 59' 17" W., continuing along the centerline of Tallmadge Road, C.H. 18, a distance of 1184.99 feet to an angle point; thence S. 89 degrees 59' 17" W., continuing along the centerline of Tallmadge Road, C.H. 18, a distance of 281.25 feet to a point at the Northwesterly corner of lands owned by L. Evans, said point being the true place of beginning for the herein parcel of land; thence S. 00 degrees 43" E., along the Westerly line of said Evans land and passing over a 5/8" long iron pin set with ID cap at 33.00 feet, a total distance of 164.45 feet to a 5/8" 30" long iron pin set with ID cap in the Northerly line of lands owned by T. Clark; thence N. 69 degrees 49' 27" W., along the Northery line of said Clark lands, a distance of 183.00 feet to a 3/4" iron pin found at the Southeasterly corner of lands owned by S. & J. Merchansky; thence N. 00 degrees 00' 43" W., along the Easterly line of said Merchansky lands and passing over a R/W monument found at 130.85 feet, a total distance of 163.85 feet to a point in the centerline of Tallmadge Road, C.H. 18; thence N. 89 degrees 59' 17" E., along the centerline of Tallmadge Road, C.H. 18, a distance of 183.00 feet to a point, returning to the true place of beginning and containing an area of 0.690 acres (0.139 acres being within the road right-of way) as reserved by Danny L. Wilson, P.S. Ohio 7238 in May 2001. Be the same more or less, but subject to all legal highways.

Said Premises Located at 10322 Tallmadge Rd., Diamond, OH 44412.

Said Premises Appraised at $65,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
