In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, October 31, 2005, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Mantua to-wit:

Situated in the Township of Mantua, County of Portage, State of Ohio, being part of Lot 19 in said township and bounded and described as follows:

Beginning at a point in the Easterly line of Lot 19 at the intersection of centerlines of S.R. 82, and C.H. 285, Chamberlian Road;

1. Thence S. 67 degrees 10' 00" W., along the centerline of S.R. 82, a distance of 742.58 feet to a point;

3. Thence N. 61 degrees 09' 00" W., continuing along the centerline of S.R. 82, a distance of 537.48 feet to a point;

4. Thence N. 54 degrees 02' 00" W., continuing along the centerline of S.R. 82, a distance of 255.71 feet to a point at the Northwesterly corner of land now or formerly owned by G. & M. Naim (Volume 966, Page 456) which marks the true place of beginning for the following described parcel of land;

5. Thence S. 00 degrees 14' 15" E., (passing over a 5/8" iron rod set at 37.20 feet) a distance of 1409.20 feet to a 1" iron pipe found at the Southwesterly corner of said Naim;

6. Thence N. 89 degrees 46' 11" E., along the Southerly line of Naim a distance of 161.31 feet to a 1" iron pipe found in the Westerly line of land now or formerly owned by D. L. and D. Vesely (Volume 1051, Page 299);

7. Thence S. 00 degrees 14' 26" E., along Vesely's Westerly line a distance of 466.61 feet to a 5/8" iron rod set in the Southerly line of Lot 10 which is also the Northerly line of Conrail;

8. Thence S. 89 degrees 31' 37" W., along the Southerly line of Lot 19, a distance of 393.56 feet to a 5/8" iron rod set;

9. Thence N. 00 degrees 14' 16" W., (passing over a 5/8" iron rod at 201.92 feet) a distance of 1710.66 feet to a 5/8" iron rod set;

10. Thence N. 85 degrees 42' 09" W., a distance of 191.90 feet to a 5/8" iron rod set;

11. Thence N. 01 degrees 39' 00" E., (passing over a 5/8" iron rod set at 419.68 feet) a distance of 461.29 feet to a point in the centerline of S.R. 82;

12. Thence S. 50 degrees 01' 38" E., along the centerline of S.R. 82, a distance of 122.38 feet to a point;

13. Thence S. 54 degrees 02' 00" E., continuing along the centerline of S.R. 82, a distance of 390.24 feet to the true place of beginning, containing a total of 13.8735 acres of land, more or less, excluding 0.7332 acres, more or less which is in Conrail property, leaving a net of 13.1403 acres, more or less, as surveyed by Rob A. Beginning at a point in the Easterly line of Lot 19, at the intersection of the centerlines of C.H. 265, Chamberlain Road and S.R. 82; thence S. 87 deg. 10' 00" along the centerline of S.R. 82 a distance of 742.58 feet to a point; thence N. 63 deg. 43' 00" W., continuing along the centerline of S.R. 82 a distance of 580.41 feet to a point; thence N. 61 deg. 09' 00" W., continuing along the centerline of S.R. 82 a distance of 537.48 feet to a point; thence N. 54 deg. 02' 00" W. continuing along the centerline of S.R. a distance of 255.66 feet to a point at the Northeasterly corner of land now or formerly owned by R. D. or R. J. Seaman (O.R. 354, Page 396); thence S. 00 deg. 14' 15" E. along the Easterly line of said Seaman a distance of 337.20 feet to a 1/2" iron rod set, which marks the true place of beginning for the following described parcel of land; thence continuing S. 00 deg. 14' 15" E. along the Easterly line of Seaman a distance of 320.00 feet to a 1/2" iron rod set; thence S. 89 deg. 45' 45" W. a distance of 80.00 feet to a 1/2" iron rod set; thence N. 06 deg. 53' 15" E. a distance of 322.49 feet to a 1/2" iron rod set; thence N. 89 deg. 45' 45" E. a distance of 40.00 feet to the true place of beginning, containing 0.4408 acres of land, more or less, as surveyed and described August 8, 2001, by Rob A. Szuch, Registered Professional Surveyor No. 7288.

Said Premises Located at 2900 S.R. 82, Aurora, OH 44202.

Said Premises Appraised at $300,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
