In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, October 17, 2005, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Palmyra to-wit:

Situated in the Township of Palmyra, County of Portage and State of Ohio:

Being part of Lot 2, Division 4, S.E. in said township and bounded and described as follows:

Beginning at a 1" iron bar found in the West line of Lot 2, Division 4, S.E. at the intersection of the centerline of C.H. 136, Jones Road and C.H. 131, Williams Road; thence S. 89 deg. 59' 25" E., along the centerline of C.H. 131, a distance of 926.98 feet to a point at the Northeast corner of land now or formerly owned by J. F. or C. V. Diliberto (O.R. 270, Pg. 293), which marks the true place of beginning for the following described parcel of land; thence continuing S. 89 deg. 59' 25" E., along the centerline of C.H. 131, a distance of 417.42 feet to a point at the Northwest corner of land now or formerly owned by H. E. Grocott (Vol. 1108, Pg. 197); thence S. 01 deg. 07' 35" W., along the West line of said Grocott (passing over a 5/8" iron rod set at 30.01 feet) a distance of 626.13 feet to a 5/8" iron rod found at another Northeast corner of the aforementioned Diliberto; thence N. 89 deg. 59' 25" W., along a North line of Diliberto a distance of 208.71 feet to a 5/8" iron rod found in an East line of Diliberto; thence N. 01 deg. 07' 35" E., along Diliberto's said East line a distance of 417.42 feet to a 5/8" iron rod found in a North line of Diliberto; thence N. 89 deg. 59' 25" W., along Diliberto's said North line a distance of 208.71 feet to a 5/8" iron rod found in an East line of Diliberto; thence N. 01 deg. 07' 35" E., along Diliberto's said East line (passing over a 5/8" iron rod found at 178.70 feet) a distance of 208.71 feet to the true place of beginning, containing 3.9992 acres of land, more or less, (of which 0.2874 acres, more or less, are in the R/W of C.H. 131) as surveyed and described June 9, 1999 by Rob A. Szuch, Registered Professional Surveyor No. 7288.

Said Premises Located at 10618 Williams Road, Diamond, OH 44412.

Said Premises Appraised at $115,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
