In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, September 26, 2005, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Garrettsville to-wit:

Situated in the City of Garrettsville, County of Portage and State of Ohio:

And known as being part of Original Lot No. 1 of Nelson Township and further described as being the North 27 feet of Lot No. 169, Village of Garrettsville as surveyed and plotted by J. Cole in 1870, county and state aforesaid, and further described as follows:

Beginning at a monument in the center line of South Street at its intersection with the South corporation line of Garrettsville; thence North 00 degrees 03' East along the center line of South Street for a distance of 2016, 23 feet to a point; thence South 87 degrees 57' East a distance of 30.00 feet to an iron pipe which marks the true place of beginning of the following described parcel of land; thence continuing South 87 degrees 57' East for a distance of 300.00 feet to an iron pipe; thence North 00 degrees 03' East for a distance of 27 feet to an iron pipe at the Northeast corner of Lot No. 169; thence North 87 degrees 57' West along the North side of said Lot No. 169 for a distance of 300.00 feet to an iron pipe in the East line of South Street; thence South 00 degrees 03' West along the East side of South Street for a distance of 27.00 feet to the true place of beginning and found to contain 0.186 acres of land as surveyed by Lucius F. Converse, Serial No. 1199, in September, 1955.

PARCEL NO. 2:

Situated in the said village, county and state, and known as being part of Original Lot No. 1 of Nelson Township and further described as being the South 50 feet of Lot No. 168, Village of Garrettsville as surveyed by J. Cole in 1870, county and state aforesaid and further described as follows:

Beginning at a monument in the center line of South Street at its intersection with the South corporation line of the Village of Garrettsville; thence North 00 degrees 03' East along the center line of South Street for a distance of 2043.23 feet to a point; thence South 87 degrees 57' East for a distance of 30.00 feet to an iron pipe which is the true place of beginning; thence continuing South 87 degrees 57' East for a distance of 300.00 feet to the Southeast corner of said Lot No. 168; thence North 0 degrees 03' East along the East side of said Lot No. 168 for a distance of 50.00 feet to an iron pipe; thence North 87 degrees 57' West (parallel) with the South line of said Lot No. 168 and 50.00 feet Northwardly (therefrom) for a distance of 300.00 feet to an iron pipe in the East line of South Street; thence South 00 degrees 03' West along the East side of South Street for a distance of 50.00 feet to the true place of beginning and found to contain 0.344 acres of land as surveyed by Lucius F. Converse, Serial No. 1199, in September, 1955, be the same more or less, but subject to all legal highways.

Said Premises Located at 10512 South Street, Garrettsville, OH 44231.

Said Premises Appraised at $95,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
