In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, September 12, 2005, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Edinburg to-wit:

Situated in the Township of Edinburg, County of Portage and State of Ohio:

Situated in the township, county and state aforesaid and known as being a part of Lot No. 25 in the N.W. quarter of said township, and bounded and described as follows:

Beginnning in the center of the E. and W. Center Road of said township about 5 chains 40 links E. of the West line of said lot, which is also the S.E. corner of lands covered by C. A. Meyers, et al. to Lyle B. Bingham, be deed dated March 18, 1902, and recorded in Vol. 185, Page 606, Portage County Records (now owned by H. Pringle); thence 87 degrees 15' E., along the centerline of said road 9 chains 31 links, more or less to the W. line of lands conveyed by Georgia Shilliday, et al. to Peter and Candis Wertenberger by deed dated March 7, 1919, recorded in Vol. 245, Page 512 of Portage County Records (now owned by M. H. Beatty); thence N. 0 degrees 30' E., along said W. line 5 chains 1 link more or less to the S. line of lands conveyed by James E. Wilson, et al. to Alexander Thorn by deed dated November 29, 1928, recorded in Vol. 316, Page 519, Portage County Records (now owned by G. E. Garvin); thence S. 86 degrees 15' W., along said Southerly line 9 chains 29 links, more or less, to the E. line of lands conveyed by Lyle E. Bingham as aforesaid; thence S. along said Easterly line 5 chains to the place of beginning, containing 4.60 acres of land, be the same more or less, but subject to all legal highways.

EXCEPTING THEREFROM, the following described premises:

Situated in the township, county and state aforesaid, and known as being part of Lot No. 25 in the N.W. one quarter of said township, being bounded and described as follows:

Beginning at the S.W. corner of S.D. 15 in said lot and being the S.E. corner of land now or formerly owned by Lyle Bingham, now owned by Hartzel Pringle, said point witnssed by an iron pipe set 30 ft. N. thereof; thence N. 0 degrees 30' W., 330.00 feet to an iron pipe; thence N. 87 degrees 23' E., 132.00 feet to an iron pipe to a point witnessed by an iron pipe set 30 feet N. thereof; thence S. 87 degrees 23' W., 132.00 feet to the place of beginning, containing 1 acre.

Said Premises Appraised at $150,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
