In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, August 15, 2005, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

And known as being a parcel of land located in Lot 55, Randolph Township, Portage County, State of Ohio and being further described as follows:

Commencing at a monument box at the Southwesterly corner of Lot 55, said point being the intersection of the centerline of S.R. 44, Ravenna, Louisville Rd., (S.H. 74) and Alexander Rd. (T.H. 27); thence South 88 deg. 59' East along the Southerly line of Lot 55 and the centerline of Alexander Road (T.H. 27) a distance of 1124.88 feet to an iron pin found on said line, said point being the Southwesterly property corner of land now or formerly owned by Carol Houchin; thence North 1 deg. 09' East along the Westerly property line of land now or formerly owned by Carol Houchin a distance of 440.00 feet to an iron pin found at the Northwesterly corner of said property; thence South 89 deg. 17' East along the Northerly property line of land now or formerly owned by Carol Houchin, a distance of 10.00 feet to an iron pin set on said line, said point being the True Place of Beginning for this survey; thence North 76 deg. 46' 59" East along a line running through the Grantors property a distance of 86.30 feet to an iron pin set; thence South 80 deg. 39' 31" East along a line running through the Grantors property a distance of 80.90 feet to an iron pin set; thence South 81 deg. 34' 47" East along a line running through the Grantors property a distance of 145.73 feet to a spike found, said point being on the Northerly property line of land now or formerly owned by John William or Terry Lynn McKinley; thence North 66 deg. 07' 38" West along the Northerly property line of land now or formerly owned by Carol Houchin, a distance of 162.11 feet to an iron pin found at an angle point in said property line; thence North 89 deg. 17' West along the Northerly property line of land now or formerly owned by Carol Houchin, a distance of 160.00 feet to the True Place of Beginning for this survey and containing 0.084 acres of land as surveyed December, 1980 by Floyd L. Thomas and Samuel C. Janka, Reg. Surveyors Nos. 5461 and 5739 of the State of Ohio. Be the same more or less, but subject to all legal highways.

Situated in the Township of Randolph, County of Portage and State of Ohio, and known as being part of Lot 55 in said township, more fully described as follows:

Beginning at a point in the South line of Lot 55, which is also the centerline of Alexander Rd. (T.H. #27) said point being S. 89 deg. E. 1125.00 feet from the Southwest corner of Lot 55; thence N. 1 deg. 07' E. 350.00 feet to the True Place of Beginning; thence continuing N. 1 deg. 07' E. 90.00 feet; thence S. 89 deg. E. 150.00 feet; thence S. 65 deg. 50' 35" E. 152.11 feet; thence N. 88 deg. 53' W. 100.00 feet; thence S. 1 deg. 07' W. 30.00 feet; thence N. 89 deg. 07' 20" W. 190.00 feet to the place of beginning. Containing .4327 acres. The Grantors also convey in fee simple to the said Grantees a twenty (20) foot parcel of land bounded and described as follows:

W. 20 feet to the place of beginning. Containing .18 acre and subject to all legal highways. Also known as 4129 Alexander Road, Atwater, Ohio 44201. Be the same more or less, but subject to all legal highways.

EXCEPTING THEREFROM THE FOLLOWING DESCRIBED PARCEL OF LAND:

And known as being a parcel of land located in Lot 55, Randolph Township, Portage County, State of Ohio, and being further described as follows:

Commencing at a monument box at the Southwesterly corner of Lot 55, said point being the intersection of the centerline of S.R. 44, Ravenna-Louisville Rd. (S.H. 74) and Alexander Rd. (T.H. 27); thence South 8 deg. 56' East along the Southerly line of Lot 55 and the centerline of Alexander Rd. (T.H. 27) a distance of 1124.88 feet to an iron pin found on said line, said point being the Southeasterly property corner of land now or formerly owned by Robert K. Rogers and Wilma L. Rogers, said point also being the True Place of Beginning for this survey; thence N. 1 deg. 09' East along the Easterly property line of land now or formerly owned by Robert D. Rogers and Wilma L. Rogers, and passing over an iron pin found 30.00 feet from the centerline of Alexander Rd. (T.H. 27), a distance of 440.00 feet to an iron pin found, said point being an angle point in said property line; thence South 89 deg. 17' East along the Southerly property line of land now or formerly owned by Robert E. Rogers and Wilma L. Rogers, a distance of 10.00 feet to an iron pin set on said property line; thence South 1 deg. 08' 59" West along a line running through the Grantors property line and passing over an iron pin set 30.00 feet from the centerline of Alexander Rd. (T.H. 27) a distance of 440.06 feet to a point on said centerline; thence North 88 deg. 56' West along the centerline of Alexander Rd. (T.H. 27) a distance of 10.00 feet to the True Place of Beginning for this survey and containing 0.101 acres of land as surveyed Dec. 1980 by Floyd L. Thomas and Samuel C. Janka, Reg. Surveyors Nos. 5461 and 5739 of the State of Ohio. Be the same more or less, but subject to all legal highways.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
