In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, June 20, 2005, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Franklin to-wit:

Situated in the Township of Franklin, County of Portage, State of Ohio:

Known as being a part of Original Township Lot 76, and being more particularly bounded and described as follows:

Commencing at the Northeast corner of Lot 125 of West Twin Lakes Allotment as recorded in Plat Volume 3, Page 18 of the Portage County Records Department in the West line of State Route 43 (Cleveland-Canton Road)(60.00 foot right-of-way); thence S. 02 deg. 22' 00" W., along the West line of said State Route 43, 425.00 feet to the South line of land now or formerly owned by J. L. Mares as recorded in Deed Volume 911, Page 117 of the Portage County Records Department; thence S. 86 deg. 05' 58" E., leaving said West line of State Route 43 along said South line of Mares land, 30.01 feet to the centerline of State Route 43 and being to the place of beginning for the parcel of land herein to be described (witness a 1" pipe found 0.43 feet South, 28.06 feet West distant therefrom along the last described course); thence S. 02 deg. 22' 00" W., along said centerline of State Route 43, 100.00 feet to a point in the North line of land now or formerly owned by Peter O. Stackelberg as recorded in Deed Volume 1127, Page 553 of the Portage County Records Department; thence N. 86 deg. 05' 58" W., along the North line of said Stackelberg land, passing over a drill hole found at 27.89 feet and a 1/2" rebar with "Millman" cap set at a distance of 89.74 feet, a total distance of 94.74 feet to a point in the East bank of West Twin Lake; thence N. 06 deg. 10' 53" E., along the East bank of said West Twin Lake, 85.44 feet to a point; thence N. 31 deg. 02' 37" W., continuing along the East bank of said West Twin Lake, 17.80 feet to a point; thence S. 86 deg. 05' 58" E., passing through a 1" pipe found at 5.68 feet, a total distance of 98.86 feet to the place of beginning and containing 0.2116 acres (9,216 square feet) of land and subject to any legal highways, right-of-ways, or easements of record as determined by Timothy R. Durr, Registered Land Surveyor No. S-7788 from a survey made in September of 1999 for and on behalf of Millman Surveying, Inc. The meridian for the bearings stated hereon is N. 2 deg. 22' E., as the centerline of S.R. 43 per Twin Lakes Allotment as recorded in Plat Volume 3, Page 18 of the Portage County Records Department. Be the same more or less, but subject to all legal highways.

Said Premises Located at 7521 State Route 43, Kent, Ohio 44240.

Said Premises Appraised at $150,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
