In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, June 6, 2005, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Freedom to-wit:

Situated in the State of Ohio, County of Portage and the Township of Freedom, and known as being part of Lot 3, in said township, also known as being all of that parcel conveyed to M. F. O'Donnell and S. M. Kornatz as recorded in O.R. 246, Page 458, and being more fully bounded and described as follows, to wit:

Beginning at a 1" iron bar found at the Southwest corner of Lot 3; thence South 86 deg. 00' 00" East, along the South line of Lot 3 and the center line of Gotham Road (T.H. 232-A) 60' R/W, 502.70' to the Southeast corner of a parcel conveyed to K. or T. Copojohn (1144/133) and being the TRUE PLACE OF BEGINNING for the parcel hereinafter described; thence North 03 deg. 59' 04" East, along the East line of said Copojohn parcel, (passing over a 5/8" rebar w/cap set at 30.00') 1126.04' to a point in the South line of a parcel conveyed to L. A. Bujalski (O.R. 369, Pg. 380) (witness a 3/4" pipe found 0.21' North); thence South 86 deg. 00 min. 00 sec. East, 265.63', along the South line of said Bujalski parcel, to the Northwest corner of a parcel conveyed to K. H. and D. E. Reed (1027/254) (witness a 3/4" pipe found 0.33' North + 1.35' West); thence South 03 deg. 58 min. 11 sec. West, 566.89', along the West line of Reed parcel, to a 1/2" pipe found at an angle in said line; thence North 85 deg. 33 min. 35 sec. West, 90.67', continuing along Reed's line, to a 1/2" pipe found; thence South 03 deg. 57 min. 02 sec. West, 506.21' continuing along the West line of said Reed parcel, to a point in the center line of said Gotham Road (passing over a 3/4" pipe found 30.09' from center line); thence North 86 deg. 00 min. sec. West, 175.44', along the center line of Gotham Rd. to the TRUE PLACE OF BEGINNING and containing 5.708 acres of land, more or less, as determined from a survey by Stephen P. Campbell, P.L.S. No. 7330 of Campbell and Associates, Inc. in March 2001, (C&A project 20011065).

The bearings used for this description are based on the bearing of Gotham Road as shown in O.R. 246, Page 458.

Said Premises Located at 7923 Gotham Road, Garrettsville, OH 44231.

Said Premises Appraised at $180,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
