In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, March 14, 2005, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

And known as being part of Lot 48 in Rootstown Township and further described as follows:

Beginning at a point in the center-line of Old Forge Road at the Grantor's Northeast corner and being S. 55 deg. 24' 20" W. 514.08 feet from an iron pipe at the intersection of said road centerline with the North line of Lot 48; thence S. 0 deg. 28' 20" W. 326.59 feet to the Southwest corner of W. Arbogast; thence S. 50 deg. 28' 50" E. 407.50 feet along the Grantor's Easterly line; thence S. 83 deg. 40' W. 473.78 feet to the Grantor's Southwest corner as deeded in Volume 870, Page 48, in the Portage County Records and passing over an iron pipe at 171.59 feet; thence N. 24 deg. 09' 50" W. 453.79 feet along the Grantor's West line to an iron pipe in the centerline of Old Forge Road; thence N. 59 deg. 44' 20" E. 172.44 feet along the centerline of Old Forge Road to a monument; thence N. 55 deg. 24' 20" E. 238.39 feet along the centerline of Old Forge Road to the beginning. Containing 4.24 acres of land, be the same more or less, but subject to all legal highways, as surveyed in January, 1979 by David J. Collier, Registered Surveyor No. 4819.

Also subject to a 30 feet wide drive easement along the West side of the parcel as follows:

Starting at an iron pipe at the intersection of the North line of Lot 48 with the centerline of Old Forge Road; thence S. 55 deg. 24' 20" W. 752.47 feet along the centerline of Old Forge Road to a monument; thence S. 59 deg. 44' 20" W. 172.44 feet along the centerline of Old Forge Road to an iron pipe at the Northwest corner of Dempsey T. Reed; thence S. 24 deg. 09' 50" E. 30.17 feet along Reed's West line to a point in the Southerly line of Old Forge and being the true place of beginning; thence N. 59 deg. 44' 20" E. 30.17 feet along the Southerly line of Old Forge Road; thence S. 24 deg. 09' 50" E. 436.61 feet; thence S. 83 deg. 53' 40" W. 31.55 feet to Reed's Southwest corner; thence N. 24 deg. 09' 50" W. 423.62 feet along Reed's West line to the true place of beginning. Vendor herein reserves to itself, its successors and assigns, all right, title and interest in and to all mineral rights, under, upon above described premises.

If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
