In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, February 7, 2005, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Deerfield to-wit:

Situated in the Township of Deerfield, County of Portage and State of Ohio:

And known as being part of Lot No. 31 in said township and more fully bounded and described as follows to-wit:

Beginning in the South line of Lot No. 31, which is the North line of U.S. Route No. 224, South 89 degrees, East 129.00 feet from the Southwest corner of said lot No. 31 (an iron pipe is South 1 degree West 3.00 feet); thence along the South line of said lot No. 31 and North line of U.S. Route No. 224, South 89 degrees East 870.40 feet to the land of Augustus H. and Lucy M. Hartzell, as recorded in volume 348, Page 28, Portage County Records. (an iron pipe is South 1 degree West 3.00 feet); thence along the line between Moorman and Hartzell North 0 degrees 3' East 300.00 feet to an iron pipe; thence continuing along said line North 89 degrees West 132.00 feet to an iron pipe; thence continuing along said line North 0 degrees 3' East, 1821.70 feet to an iron pipe at the corner of land of Florence S. Johnston and Fern S. Richardson as recorded in volume 458, Page 183, Portage County Records; thence along the line between said Johnston-Richardson and Moorman North 89 degrees 38' West 738.50 feet to an iron pipe; thence continuing along said line South 0 degrees 3' West 2156.50 feet to the place of beginning, and containing 37.515 acres of land, more or less, but subject to all legal highways, as surveyed in August, 1951, by Leo E. Martin, registered surveyor No. 2587. EXCEPTING THEREFROM the following decribed premises: located in Lot 31, Deerfield Township, and being further described as follows:

Beginning at the Southwest corner of Lot 31 on the centerline of U.S. Route 224 (Akron-Canfield Road); thence South 89 degrees 00' East, a distance of 129.00 feet alogn the South line of Lot 31 and centerline of U.S. Route 224 to a point at the Southeast corner of W.M. Carver and the Southwest corner of this Grantor which is the true place of beginning; thence North 0 degrees 17' 50" East, a distance of 2103.00 feet along the West line of this Grantor to an iron pipe found and passing over an iron rod set at 30.00 feet on the right of way line as marked by Ohio Highway Monuments; thence South 88 degrees 40' 40" East a distance of 235.00 feet along the North line of this Grantor to an iron rod set; thence 0 degrees 17' 59" West a distance of 2102.30 feet to a point on the centerline of U.S. Route 224 and passing over an iron rod set at 10.00 feet from the centerline; thence North 89 degrees 00" West a distance of 235.00 feet along the said centerline to the true place of beginning, containing 11.773 acres of land as surveyed by Terrance Hohnhorst, reg. professional land surveyor No. 5065, October, 1974.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
