In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Joseph R. Kainrads Courtroom in Ravenna, in the above named County, on Monday, November 15, 2004, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Palmyra to-wit:

Situated in the Township of Palmyra, County of Portage and State of Ohio:

Located in Lot 24, Subdivision 3 South, Palmyra Township, Portage County, Ohio and being further described as follows:

Beginning at a point at the Southwest corner of said Lot 24 at the intersection of the centerlines of State Route 225 and County Highway 55, Yale Road; thence North 01 deg. 51' 00" West, a distance of 276 15 feet along the West line of Lot 24 and centerline of State Route 225 to a point; thence South 88 deg. 00' East, a distance of 65 feet to an iron rod with cap set, and passing over an iron rod set at 33 10 feet from said centerline; thence South 62 deg. 00' 22" East, a distance of 480 36 feet along and near the centerline of an existing deep drainage course to a point; thence South 02 deg. 00' West, a distance of 65.00 feet to a point on the South line of Lot 24 and centerline of C.H. 55, Yale Road and passing over an iron rod with cap set at 30.00 feet from said centerline; thence North 88 deg. 00' West, a distance of 478.23 feet along the said centerline of C.H. 55 and South line of Lot 24 to the true place of beginning and containing 2 0402 acres of land as surveyed by Terrance R. Hohnhorst, Registered Professional Land Surveyor Number 5065 in March, 1997. Be the same more or less, but subject to all legal highways.

Said Premises Located at 2712 State Route 225, Diamond, Ohio 44412.

Said Premises Appraised at $85,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
