In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Joseph R. Kainrads Courtroom in Ravenna, in the above named County, on Monday, November 15, 2004, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Deerfield to-wit:

Being a parcel of land located in Lot 17, Deerfield Township, Portage County, State of Ohio, and being further described as follows:

Commencing at the intersection of the centerline of State Route 224 and Diver Road (T.H. 66); thence South 00 deg. 18' East along the centerline of Diver Road (T.H. 66), a distance of 250.00 feet to a pin found on said centerline, said point being the TRUE PLACE OF BEGINNING for this survey; thence continuing South 0 deg. 18' East along the centerline of Diver Road (T.H. 66), a distance of 232.30 feet to a point on said line, said point being the Northeasterly corner of a 2.742 acre tract of land; thence South 89 deg. 42' West along the Northerly line of a 2.742 acre tract of land, and passing over an iron pin 30.00 feet from the centerline of Diver Road (T.H. 66), a distance of 694.02 feet to an iron pin on said line and the Easterly property line of land now or formerly owned by Joser and Katherine Neubert; thence North 0 deg. 03' West along the Easterly property line of land now or formerly owned by Joser and Katherine Neubert, a distance of 233.12 feet to an iron pin on said line, said point being the Southwesterly corner of land now or formerly owned by Robert J. Braasch; thence North 89 deg. 46' East along the Southerly line of two parcels of land a distance of 280.00 feet to an iron pin found at the Southeasterly corner of land now or formerly owned by Diana L. Elliot; thence North 0 deg. 03' West along the Westerly property line of land now or formerly owned by Diana L. Elliot, and passing over an iron pin 33.00 feet from the centerline of State Route 224, a distance of 250.00 feet to a point on said centerline; thence North 89 deg. 45' East along the centerline of State Route 224, a distance of 130.00 feet to a point on said centerline; thence South 0 deg. 18' East along a line running through the Grantor's property and passing over an iron pin found 33.00 feet from the centerline of State Route 224, a distance of 250.00 feet to an iron pin; thence North 89 deg. 46' East along a line running through the Grantor's property line and passing over an iron pin found 30.00 feet from the centerline of Diver Road (T.H. 66), a distance of 281.91 feet to the TRUE PLACE OF BEGINNING for this survey and containing 4.454 acres of land, be the same more or less, but subject to all legal highways.

Said Premises Located at 1277 Diver Road, Deerfield, Ohio 44411.

Said Premises Appraised at $125,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
