In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Joseph R. Kainrads Courtroom in Ravenna, in the above named County, on Monday, September 13, 2004, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Windham to-wit:

Situated in the Township of Windham, County of Portage and State of Ohio:

Being part of Lot 93 and Lot 94 in said township and bounded and described as follows:

Beginning at an iron pipe as the Southeasterly corner of said Lot 93 in the centerline of T.H. 234 Werger Road; thence North 89 deg. 23' 33" West along the Southerly line of Lot 93 and centerline of T.H. 234 a distance of 151.50 feet to an iron pipe; thence North 00 deg. 38' 30" West (passing over an iron pipe at 30 feet) a distance of 534.46 feet to an iron pipe; thence South 81 deg. 51' 00" East a distance of 153.26 feet to an iron pipe in the Westerly line of Lot 94 at a Northwesterly corner of land now or formerly owned by Mack Tacy; thence South 00 deg. 38' 30" East along the Westerly line of Lot 94 a distance of 132.22 feet to an iron pipe at the Southwesterly corner of said Tacy; thence 89 deg. 13' 00" East along the Southerly line of said Tacy a distance of 355.28 feet to an iron pipe in the Westerly line of land now or formerly owned by J. A. & M. M. Stone; thence South 02 deg. 49' 30" East along the Westerly line of said Stone a distance of 382.76 feet to an iron pipe in the Southerly line of Lot 94 and centerline of T.H. 234; thence North 89 deg. 13' 00" West along the Southerly line of Lot 94 and centerline of T.H. 234 a distance of 369.87 feet to the place of beginning containing 5.002 acres of land, more or less, of which 1.823 acres, more or less, are in Lot 93 and 3.179 acres, more or less, are in Lot 94, as surveyed September 16, 1974 by Albert Szuch, Registered Surveyor No. 5398.

Said Premises Located at 8725 Werger Road, Garrettsville, OH 44231.

Said Premises Appraised at $120,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.

THE OWNER IS ALSO RESPONSIBLE FOR KNOWING EXACTLY WHAT HE IS PURCHASING.
