In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Joseph R. Kainrads Courtroom in Ravenna, in the above named County, on Monday, August 30, 2004, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Windham to-wit:

And being a part of Lot No. 85, and bounded and described as follows:

Beginning at a point in the centerline of S.R. #82, which point is N. 47 deg. 37' 30" W. a distance of 340.08 feet from an I.P. at an angle point in the said centerline; the said point also being 187.33 feet from the intersection of the centerline of Bryant Road (T.H. 236); thence S. 47 deg. 37' 30" E. along said centerline a distance of 340.08 feet to an I.P. at an angle point in said centerline; thence S. 77 deg. 20' E. a distance of 626.35 feet to a point; thence N. 14 deg. 19' 54" E. a distance of 976.07 feet to an I.P.; thence N. 73 deg. 09' W. a distance of 572.20 feet to a large walnut tree in the West property line of Troyer's land; thence S. 2 deg. 10' 33" W. a distance of 220.40 feet to a point; thence S. 45 deg. 30' 26" E. a distance of 66.40 feet to a point in the center of Slippery Rock Creek; thence along the center of the creek S. 51 deg. 13' 29" W. a distance of 763.59 feet to the place of beginning and containing 15.42 acres of land, more or less, as surveyed by James W. Bowen, R. L. #4839, in November, 1958.

Said Premises Located at 8999 State Route 82, Garrettsville, Ohio 44231.

Said Premises Appraised at $350,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
