In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Joseph R. Kainrads Courtroom in Ravenna, in the above named County, on Monday, August 16, 2004, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Shalersville to-wit:

Situated in the Township of Shalersville, County of Portage and State of Ohio:

And known as being part of Lot No. 49, township, county and state aforesaid, and more particularly described as follows:

Beginning at a point in the Southeast corner of said Lot 49; thence North 00 deg. 35' East along the East side of said Lot 49 and centerline of State Highway No. 44, for a distance of 318.54 feet to a point marked by a small iron pin which is the true place of beginning for the following described parcel of land. This true place of beginning is at the Northeast corner of a 20.00 acre parcel of land now or formerly owned by Frank Mesaros. This true place of beginning is also at the Southeast corner of 15.16 acre parcel of land now owned by E. J. Frank, from which the following described parcel is taken; thence North 88 deg. 11' 25" West along the North line of said Mesaros land for a distance of 245.06 feet to an iron pipe; thence North 00 deg. 35' East parallel with the East line of said Lot No. 49, for a distance of 380.19 feet to an iron pipe; thence at right angles to the previous course South 89 deg. 25' East for a distance of 245.00 feet to a point in the East line of said Lot No. 49, and centerline of Highway No. 44; thence South 00 deg. 35' West at right angles to the previous course along the East line of said Lot No. 49, and centerline of Highway No. 44 for a distance of 385.55 feet to the true place of beginning and found to contain 2.153 acres of land, as surveyed by Lucius F. Converse, Serial No. 1199, in March 1957.

Said Premises Located at 9959 State Route 44, Mantua, OH 44255.

Said Premises Appraised at $125,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
