In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Joseph R. Kainrads Courtroom in Ravenna, in the above named County, on Monday, July 19, 2004, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Nelson to-wit:

Situated in the Township of Nelson, County of Portage and State of Ohio:

And known as being part of Lot No. 41, Township, County and State aforesaid and more particularly described as follows:

Beginning at an iron pin found at the Northeast corner of said Lot No. 41. This iron pin is also the centerline of State Route No. 305; thence North 87 deg. 31' 12" West along the North line of said Lot No. 41 and centerline of State Route No. 305 for a distance of 874.50 feet to an iron pin found at the centerline intersection of State Route No. 305 and Kyle Road, Highway No. 311 (60' wide); thence South 01 deg. 16' 48" West along the centerline of Kyle Road, Highway No. 311, for a distance of 3,375.68 feet to an iron pin which marks the true place of beginning of the following described parcel of land; thence South 88 deg. 43' 12" East along the South side of 4 1/3 acre parcel of land for a distance of 874.50 to an iron pin at the Southeast corner of said 4 1/3 acre parcel of land; thence South 01 deg. 15' 48" West for a distance of 215.83 feet to an iron pin at the Northeast corner of a 2.17 acre parcel of land in the name of Belknap and recorded in Volume No. 853 at Page No. 62 of Portage County Record of Deeds; thence North 88 deg. 43' 12" West along the North side of said Belknap property for a distance of 874.50 feet to an iron pin the centerline of Kyle Road; thence North 01 deg. 16' 48" East for a distance of 215.83 feet to the true place of beginning and found to contain 4 1/3 acres of land as surveyed by Lucius F. Converse, C.E. Registered Surveyor No. 1199 in August 1970.

Note:

Iron pins were found or set 30.00 feet Eastwardly from the centerline of Kyle Road on both of the East and West lines, be the same more or less, but subject to all legal highways.

Said Premises Located at 11304 Kyle Road, Garrettsville, OH 44231.

Said Premises Appraised at $80,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
