In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Joseph R. Kainrads Courtroom in Ravenna, in the above named County, on Monday, May 3, 2004, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Edinburg to-wit:

Situated in the Township of Edinburg, County of Portage and State of Ohio:

Being a parcel of land located in Lot 2 S. E. Sub. Div. 3 Edinburg Township, Portage County, State of Ohio, and being further described as follows:

Commencing at the Northeasterly corner of Lot 2 S. E. Sub. Div. 3 said point also being the intersection of the centerline of Porter Road (T.H. 54) and the Southerly right of way line of Tallmadge Rd. (C. H. 18); thence North 89 degrees 17 minutes 40 seconds West along the Northerly line of Lot 2 S. E. Sub. Div. 3, and the Southerly right of way line of Tallmadge Rd. (C.H. 18), a total distance of 405.00 feet to an iron pin set, said point being the true place of beginning for this survey; thence South 0 degrees 43 minutes 20 seconds West along the Westerly property line of land now or formerly owned by Harold and Ruby Phillips, a total distance of 641.51 feet to an iron pin set on said land; thence North 80 degrees 17 minutes 40 seconds West along a line running through the grantors property a distance of 160.25 feet to an iron pin set; thence North 0 degrees 43 minutes 20 seconds East along a line running through the grantors property a total distance of 641.51 feet to an iron pin set on the Northerly line of Lot 2 S. E. Sub. Div. 3; thence South 89 degrees 17 minutes 40 seconds East along the Northerly line of Lot 2 S. E. Sub. Div. 3, a total distance of 160.25 feet to the true place of beginning for this survey and containing 2.360 acres of land more or less as surveyed in March, 1974, by Floyd L. Thomas and Samuel C. Jenka, Reg. Surveyors No. 5461 and 5739 of the State of Ohio.

Said Premises Located at 7436 Tallmadge Road, Rootstown, OH 44272.

Said Premises Appraised at $70,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
