In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Joseph R. Kainrads Courtroom in Ravenna, in the above named County, on Monday, April 26, 2004, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Mantua to-wit:

Situated in the Township of Mantua, County of Portage and State of Ohio:

And known as being part of Lots No. 34 and No. 40, township, county and state aforesaid and more particularly described as follows:

Beginning at a marked stone in the common line between Lots No. 34 and 40 at the Southeast corner of a parcel of land now or formerly owned by Howard and Bernice Holiday as described in Volume 458, Page 35 of Portage County Record of Deeds. This stone is situated 400.62 feet North 89 deg. 50' West from a point at the intersection of the centerline of Highway No. 256, and the West corporation line of the Village of Mantua measured along the common lot line; thence North 00 deg. 30' East along the East side of said Holiday land for a distance of 68.89 feet to an iron pin in the centerline of Highway No. 256 (also known as Mennonite Road); thence North 72 deg. 15' West along the centerline of Highway No. 256 for a distance of 1,060.25 feet to an iron pipe at the Northwest corner of a parcel of land now owned by Frank W. Wilford which is the true place of beginning of the following described parcel of land; thence South 10 deg. 16' West along the West side of said Wilford land for a distance of 497.19 feet to an iron pipe at an angle; thence South 2 deg. 43' East along the West side of said Wilford land for a distance of 312.69 feet to an iron pipe in the center of the creek at the North property line of the Erie Railroad; thence North 39 deg. 21' West along the North property line of the Erie Railroad for a distance of 267.82 feet to an iron pipe; thence North 10 deg. 16' East for a distance of 645.97 feet to an iron pipe in the centerline of Highway No. 256; thence South 72 deg. 15' East along the centerline of Highway No. 256 for a distance of 135.00 feet to the true place of beginning and found to contain 2.329 acres of land as surveyed by Lucius F. Converse, Registered Surveyor No. 1199 in June, 1957.

NOTE:

Iron pipes were found or set South 10 deg. 16' West, a distance of 31.13 feet from the centerline of Highway No. 256 on both of the North and South lines.

NOTE:

1.252 acres are situated in Lot No. 40 and 1.077 acres are situated in Lot No. 34, be the same more or less, but subject to all legal highways.

Said Premises Appraised at $110,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
