In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Joseph R. Kainrads Courtroom in Ravenna, in the above named County, on Monday, April 19, 2004, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Atwater to-wit:

PARCEL NO. 1:

Situated in the Township of Atwater, County of Portage and State of Ohio:

And known as being part of Lot 130 in Atwater Township and further described as follows:

Beginning in the West line of Lot 130 and in the centerline of Industry Road, C.H. 47 and being North 629.10 feet from the Southwest corner of Lot 130; thence North 150.00 feet along the centerline of Industry Road and the lot line; thence North 89 degrees 12' 30" East a distance of 724.96 feet to an iron pipe and passing over an iron pipe 30.00 feet from the road center; thence South 0 degrees 09' 45" East a distance of 150.00 feet to a iron pipe; thence South 98 degrees 12' 30" West a distance of 725.38 feet along the Grantor's South line to the beginning. Containing 2.4971 acres of land, be the same more or less but subject to all legal highways, as surveyed by David J. Collier, Registered Surveyor No. 4819.

PARCEL NO. 2:

Beginning at a point in the centerline of Industry Road and the West line of Atwater Township and being North 779.10 feet from the Southwest corner of Lot 130; thence North 75.00 feet along the centerline of Industry Road and the township line; thence North 89 degrees 12' 30" East a distance of 724.75 feet to a point in Grantor's East line; thence South 0 degrees 09' 45" to a distance of 75.00 feet to an iron pipe at the Southwest corner of a 2.496 acre parcel owned by the Grantor; thence South 89 degrees 12' 30" West a distance of 724.96 feet to the beginning and passing over an iron pipe 30 feet from the road center. Containing 1.248 acres of land, be the same more or less but subject to all legal highways, as surveyed by David J. Collier, Registered Surveyor No. 4819.

Said Premises Located at 1366 Industry Rd., Atwater, OH 44201.

Said Premises Appraised at $120,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
