In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Joseph R. Kainrads Courtroom in Ravenna, in the above named County, on Monday, November 24, 2003, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Garrettsville to-wit:

Situated in the Village of Garrettsville, County of Portage and State of Ohio and known as being part of Original Hiram Township Lot No. 46, and more fully described as follows:

Beginning at a point on the centerline of Freedom Street (60 ft. wide), and the Northeasterly corner of a parcel of land conveyed to Garrettsville Development and Design by deed recorded in Volume 1163, page 249 of Portage County Records; thence South 12 degrees 06' 41" East, and passing through a 1" bolt found 33.71 ft. from the centerline, and along the Easterly line of said parcel conveyed to Garrettsville Development and Design, 242.49 ft. to an existing 5/8" iron pin; thence South 0 degrees 06' 45" East, and continuing along the Easterly line of said parcel conveyed to Garretsville Development and Design, 40.00 ft. to a 5/8" iron pin set; thence South 89 degrees 53' 15" West, 86.85 feet to a 5/8" iron pin set; thence North 38 degrees 29' 03" West, 139.69 ft. to a 5/8" iron pin set and the P.C. of a curve turnout; thence by the arc of a curve turnout: radius = 25.00 ft., delta = 90 degrees 00' 00", arc = 39.27 ft., chord = 35.36 ft. and chord bearing = North 6 degrees 30' 57" East to a 5/8" iron pin set on the Southerly line of Freedom Street, as aforesaid, and the P.T. of said curve turnout; thence North 38 degrees 29' 03" West, 30.00 ft. to a point on the centerline of Freedom Street, as aforesaid; thence North 51 degrees 30' 57" East and along the centerline of Freedom Street, as aforesaid, 175.64 ft. to a point and place of beginning and containing 0.728 acres of land, according to a survey by Dennis A. Seifert and Associates, Inc. on January 26, 1996, be the same more or less, but subject to all legal highways.

Said Premises Located at 10578 Freedom Street, Garrettsville, OH 44231.

Said Premises Appraised at $110,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
