In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Joseph R. Kainrads Courtroom in Ravenna, in the above named County, on Monday, September 15, 2003, at 1:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Palmyra to-wit:

Situated in the Township of Palmyra, County of Portage and State of Ohio:

And known as being a part of Lot 3, Division 2 Center, and Lot 17, Division 3, South, of said township and further described as follows:

Beginning at the S.E. corner of Lot 3, Division 2 Center, and the N.E. corner of Lot 17, Division 3 South, which is the true place of beginning and the centerline of S.R. 225; thence the following four courses around the boundaries of property owned by C. or C. Swain:

(1) N 89 deg. 17' W. a distance of 238.00' to an I.P. and passing over an I.P. at 33.13'; (2) S 00 deg. 38' 11" W. a distance of 160.00' to an I.P.; (3) S 70 deg. 16' 35" W. a distance of 35.00' to an I.P.; (4) S 51 deg. 07' 37" W. a distance of 331.30' to an I.P.; thence N 0 deg. 30' E. a distance of 569.36' to an I.P.; thence S 89 deg. 17' E. a distance of 528.11' along the Southerly line of property owned by J.C. & P.K. DeHaven to a point in the centerline of S.R. 225 and passing over I.P.'s 33' and 99' back from said centerline; thence S 0 deg. 44" 25' W a distance of 186.00' along the center line of S.R. 225 to the true place of beginning and containing 4.013 acres of land more or less of which 2.253 acres are in Lot 3 Division 1 Center and 1.760 acres are in Lot 17 Div. 3 South, as surveyed by Edward P. Wanchick Registered Surveyor No. 5756.

Said Premises Located at 3763 State Route 225, Diamond, Ohio 44412.

Said Premises Appraised at $90,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
