In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, April 21, 2025, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, May 5, 2025 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Garrettsville to-wit:

And bounded and described as follows, to wit:

Known as being part of Lot No. 45 in Hiram Township, now a part of Garrettsville Township and Village, and more particularly known as a part of Subdivision No. 6 of Cole's survey made, A.D. 1870 as shown on Volume 2, Page 7, Portage County Plat Records. The premises herein conveyed are further known as being a part of the following described premises:

Commencing in the center of Silver Creek, 15 chains above the point where the line of lot crosses said stream; thence North 34 deg. 30' West, 5.75 chains; thence South 55 deg. 30' West, 8.23 chains to the center of Silver Creek; thence down the center of Silver Creek to the place of beginning, containing 5 acres, be the same more or less. Being the same land deeded to Ann E. Phelps by Charles Williams as administrator of Darwin E. Phelps Estate, by deed dated April 16, 1875, as the same is recorded in Volume 114, Page 158 of the deed records of Portage County, Ohio. The premises hereby conveyed are that part of the above described parcel beginning at a point in the center of Forest Street in said Village of Garrettsville, 74 feet Southeast from the Northwesterly corner of said above described premises:

Thence 60 feet in a Southeasterly direction along the centerline of Forest Street, and extending back in the Southwesterly direction between parallel lines from said two points in the center of Forest Street to the centerline of Silver Creek, and containing 0.84 acres of land, be the same more or less, but subject to all legal highways.

Note:

Excepting from the above described premises any part thereof resulting through change in the shore line of Silver Creek occasioned by other than natural causes or by natural causes other than accretion.

Said Premises Appraised at $215,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
