In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, November 18, 2024, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, November 25, 2024 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Atwater to-wit:

And known as being part of Lot 107, Atwater Township, bounded and described as follows:

Commencing at an iron pin at the Southeasterly corner of Lot 107, said point on the centerline of Stroup Road (C.H. 50); thence North 0 deg. 33' East along the centerline of Stroup Road (C.H. 50), a distance of 450.00 feet to a point on said line, said point being the true place of beginning for this survey; thence North 89 deg. 05' West along a line running through the Grantor's property, and passing over an iron pin set 30.00 feet from the centerline of Stroup Road (C.H. 50), a distance of 641.92 feet to an iron pin set on the Easterly property line of land now or formerly owned by Thomas R. and Ruth Dutton; thence North 0 deg. 40' East along the Easterly property line of land now or formerly owned by Thomas R. and Ruth Dutton, a distance of 150.00 feet to an iron pin set on said line; thence South 89 deg. 05' East along a line running through the Grantor's property and passing over an iron pin set 30.00 feet from the centerline of Stroup Road (C.H. 50), a distance of 641.62 feet to a point on said centerline; thence South 0 deg. 33' West along the centerline of Stroup Road (C.H. 50), a distance of 150.00 feet to the true place of beginning for this survey and containing 2.210 acres of land as surveyed in January, 1999, by Floyd L. Thomas and Samuel C. Janka, Registered Surveyors No. 5461 and 5739 of the State of Ohio.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 1015 Stroup Road, Atwater, OH 44201.

Said Premises Appraised at $305,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
