In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, September 30, 2024, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, October 7, 2024 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Brimfield to-wit:

And known as being part of Lot No. 59, Brimfield Township and being further described as follows:

Commencing at the intersection of the centerline of Sunview Drive (T.H. 999) and the centerline of S.R. 43 (Cleveland-Canton Road, S.H. 460); thence N. 0 deg. 09' E., along the centerline of S.R. 43, a total distance of 210.00 feet to a point at the Southerly corner of land owned by A. Roth, said point being the true place of beginning for this survey; thence N. 89 deg. 48' W., along the Northerly line of the Silver Springs Allotment and passing over an iron pin found at 30.00 feet at the side line of S.R. 43, a total distance of 230.00 feet to an iron pin found at the Northwesterly corner of Lot No. 4 in said allotment; thence N. 0 deg. 09' E. along a line running through a Grantor's property a total distance of 138.22 feet to an iron pin set on the Southerly property line of land now or formerly owned by G. & H. Roth; thence N. 89 deg. 49' E. along the Southerly property line of land now or formerly owned by G. & H. Roth and passing over a point at about 140 feet from the center of S.R. 43, said point being the end of a 26 foot strip of land used for driveway purposes and passing over an iron pin found at 30.00 feet at the side line of S.R. 43, a total distance of 230.00 feet to a point at the Southeasterly corner of said property; thence S. 0 deg. 09' W. along the centerline of S.R. 43, a total distance of 139.77 feet to the true place of beginning, containing 0.734 acres of land as surveyed by Samuel C. Janka and Floyd L. Thomas Sur. Nos. 5739 and 5461 of the State of Ohio, March 1971.

Situated in the City of Brimfield, County of Portage and State of Ohio:

And known as being part of Lot 59 in Brimfield Township and being further described as follows:

Beginning at an iron pipe at the Northwest corner of Sublots 9 of Silver Springs Allotment No. 1 as recorded in Plat Book 11, Page 49, in the Portage County Records; thence N. 0 deg. 09' E., 70.00 feet to an iron pipe in the Grantor's North line; thence S. 89 deg. 48' E., 100.00 feet to an iron pipe at the Grantors Northeast corner; thence S. 0 deg. 09' W., 70.00 feet to an iron pipe at the Northeastern corner of Sublot 9; thence N. 89 deg. 48' W., 100.00 feet along the North line of Sublot 9 to the beginning, containing 0.161 of an acre of land, be the same more or less, as surveyed in August 1996 by Edward J. Collier, Registered Surveyor No. 7141. Be the same more or less, but subject to all legal highways.

Said Premises Appraised at $175,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
