In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, September 23, 2024, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, September 30, 2024 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

 

Situated in Lot No. 38, Rootstown Township, Portage County, Ohio and further described as follows:

Beginning at the monument at the intersection of the center lines of County Highway No. 82, known as Old Forge Road, and Township Highway 102, known as Biltz Road; thence N. 0 degrees 11 minutes East along the center line of T.H. 102, a distance of 1834.07 feet to a point; thence N. 21 degrees 00 minutes E., along the center line of T.H. 102, a distance of 590.82 feet to a point, which is the true place of beginning; thence North 88 degrees 36 minutes W. and passing over an iron pipe 31.85 feet from the center of the road, a distance of 986.29 feet to an iron pipe; thence North 0 degrees 07 mintues W., a distance of 141.33 feet to an iron pipe; thence South 88 degrees 36 minutes E. and passing over an iron pipe 31.85 feet from the center of the road, a distance of 1040.35 feet to a point in the center of T.H. 102; thence South 21 degrees 00' W. along the center line of T.H. 102, a distance of 150.00 feet to the place of beginning and containing 3.287 acres of land, as surveyed by L. M. Satrom, Registered Surveyor No. 4226.

Said Premises Appraised at $220,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
