In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, August 26, 2024, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, September 9, 2024 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Atwater to-wit:

 

Situated in the Township of Atwater, County of Portage and State of Ohio and being part of Lot 26 in said township and bounded and described as follows:

Beginning at the Northwesterly corner of said Lot 26 at the intersection of the centerlines of C.H. 54, Porter Road and S.R. 224, Akron-Canfield Road; thence S. 89 deg. 42' 48" E., along Northerly line of Lot 26 and centerline of S.R. 224 at a distance of 217.90 feet to a point; thence S. 00 deg. 01' 20" W. (passing over an iron pipe at 33.48 feet), a distance of 379.55 feet to an iron pin in the Northerly line of land now or formerly owned by D. K. or B. S. Davis; thence N. 89 deg. 36' 32" W., along the Northerly line of said Davis (passing over an iron pipe at 194.66 feet), a distance of 219.15 feet to an iron pipe in the Westerly line of Lot 26 and centerline of C.H. 54; thence N. 00 deg. 12' 40" E. along the Westerly line of Lot 26 and centerline of C.H 54, a distance of 379.15 feet to the place of beginning, containing 1.903 acre of land, more or less, as surveyed July 15, 1974, by Albert Szuch, Reg. Sur. No. 5398.

Beginning at a 2" aluminum disc in a monument box found at the intersection of the Northwest corner of Original Lot 26 and centerline of State Route 224 Akron-Canfield Road & C.H. 54 Porter Road; thence S. 00 deg. 09' 10" W., along the West line of Original Lot 26 and centerline of C.H. 54, a distance of 325.48 feet to a point, which marks the true place of beginning for the following described parcel of land; thence S. 89 deg. 44' 37" E., (passing over a 5/8" iron rod set at 30.00 feet), a distance of 219.03 feet to a 5/8" iron rod set in the West line of land now or formerly owned by R. L. Yeager & P. Bradley (2000 02972); thence S. 00 deg. 01' 32" W., along Yeager & Bradley's said West line, a distance of 54.00 feet to a 5/8" iron rod set in the South line of land now or formerly owned by C. C. Blake & J. M. Berg (2014 10157); thence N. 89 deg. 44' 37" W., along Blake & Berg's said South line (passing over a 3/4" iron pipe found at 189.48 feet), a distance of 219.15 feet to a point in the West line of Original Lot 26 and centerline of C.H. 54; thence N. 00 deg. 09' 10" E., along the West line of Original Lot 26 and centerline of C.H. 54, a distance of 54.00 feet to the true place of beginning, containing 0.2716 acres of land, more or less, there being. 0.0372 acres, more or less, in the road R/W as surveyed and described September 27, 2022 by Rob A. Szuch, Registered Professional Surveyor No. 7288.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
