In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, July 8, 2024, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, July 22, 2024 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Paris to-wit:

Beginning at a point on the centerline of Newton Falls Road (C.H. 177) at a Northwest corner of land conveyed to J. and J. Wargo by deed recorded in Volume 713, Page 118 of Portage County Records of Deeds, said point being N. 79 deg. 14' 00" W., a distance of 851.84 feet from the centerline intersection of said Newton Falls Road and McClintocksburg Road; thence S. 1 deg. 16' 30" W., along a West line of said Wargo's land and passing over an iron pin set at 30.42 feet, a distance of 334.79 feet to a 3/4" pipe found at an interior corner thereof; thence N. 79 deg. 07' 45" W., along a North line of said Wargo's land, a distance of 264.62 feet to an iron pin set at an exterior corner thereof; thence S. 0 deg. 27' 30" W., along a West line of said Wargo's land, a distance of 606.00 feet to an iron pin set at an interior corner thereof; thence N. 89 deg. 15' 00" W., along a North line of said Wargo's land, a distance of 216.42 feet to a 1/2" iron pipe found in concrete at the Southeast corner of land conveyed to P. and D. Walton by deed recorded in Volume 937, Page 337 of Portage County Record of Deeds; thence N. 0 deg. 36' 00" E., along an East line of said Walton's land, a distance of 334.76 feet to an iron pin set at the Southeast corner of land conveyed to G. or L. Arnold by deed recorded in Volume 1114, Page 662 of Portage County Record of Deeds; thence S. 79 deg. 14' 00" E., a distance of 67.04 feet to an iron pin set; thence N. 4 deg. 35' 30" E., and passing over an iron pin set at 607.08 feet, a distance of 637.26 feet to a point on the centerline of said Newton Falls Road; thence S. 79 deg. 14' 00 "E., along said centerline, a distance of 371.73 feet to a point and the true place of beginning and containing therein 5.3956 acres of land as surveyed in July, 2003 by Jerry W. Daniel, Registered Surveyor No. 6222.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
