In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, March 11, 2024, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, March 25, 2024 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Ravenna to-wit:

 

The land referred to herein below is situated in the County of Portage, State of OH and is described as follows:

All that parcel of land in Township of Ravenna, Portage County, State of Ohio, as more fully described in Deed Book 1113, Page 398, ID# 293252000180000 and ID# 293252000190000, being known and designated as:

PARCEL ONE:

Situated in the Township of Ravenna, County of Portage and State of Ohio and known as being part of Block 8 of East Ravenna square as platted, numbered and recorded in Plat Book 5, Pages 17-20 of Portage County Records, in Ravenna Township Lot 25, S.D. and further described as follows:

Beginning at an iron pipe in the Northerly line of the Newton Falls Road and being S. 69 deg. 10' W., 154.56 feet from the intersection of said Northerly Road line with the West line of Peck Road; thence S. 69 deg. 10' 135.00 feet along the Northerly line of the Newton Falls Road to an iron pipe at the Grantor's Southwest corner; thence N. 7 deg. 00' 30" E., 280.79 feet to an iron pipe at the Grantor's Northwest corner; thence S. 83 deg. 53' E., 13.48 feet along the South line of Highland Avenue to an iron pipe; thence S. 8 deg. 28' W., 219.59 feet to the beginning. Containing 0.67 of an acre of land, be the same more or less, but subject to all legal highways as surveyed by David J. Collier, Registered Surveyor No. 4819.

Situated in the Township of Ravenna, County of Portage and State of Ohio and known as being part of Block 8 of East Ravenna squares as platted, numbered and recorded in Plat Book 5, Page 17-20, Portage County Records in Ravenna Township Lot 25, S.D. and further described as follows:

Beginning at the intersection of the Northerly line of Newton Falls Road with the West line of Peck Road; thence S. 69 deg. 10' W., 154.56 feet along the Northerly line of Newton Falls Road to an iron pipe; thence N. 5 deg. 28' E., 219.59 feet to an iron pipe in the South line of Highland Avenue; thence S. 83 deg. 53' E., 138.62 feet along the South line of Highland Avenue to the West line of Peck Road; thence S. 5 deg. 28' W., 149.53 feet along the West line of Peck Road to the beginning, containing 0.587 of an acre of land, be the same more or less, but subject to all legal highways as surveyed by David J. Collier, Registered Surveyor No. 4819.

Less and except that certain parcel of land conveyed from James J. Champ and Bonnie J. Champ, husband and wife to the State of Ohio, Department of Transportation as described in Deed Instrument 201414255 recorded 9/19/2014.

Situated in the Township of Ravenna, County of Portage, State of Ohio being part of Lot 25 of Original Ravenna Township (T 3 N, R 8 W) and being part of lands described in the deed to James J. and Bonnie J. Champ (Grantor) as recorded in Volume 0113, Page 0398 on file in the Portage County Recorder's Office and laying on the left side of the centerline of right-of-way of Newton Falls Road as shown on the Por-14-12.55 plans made by Arcadis U.S., Inc. for the Ohio Department of Transportation and more fully described as follows:

Commencing at a monument box set at the centerline-centerline intersection of Newton Falls Road and State Route 59 at Station 00+00.00; thence along said centerline of Newton Falls Road, North 64 deg. 47' 16' East, a distance of 1550.00 feet to Station 15+15.00; thence along a line perpendicular to said centerline of Newton Falls Road, North 25 deg. 12' 44" West, a distance of 30.00 feet to the existing Northerly standard highway easement line of said Newton Falls Road at 30.00 feet left of Station 15+50.00 where an iron pin set at the point of beginning for the parcel herein described:

1. Thence through the Grantor, North 36 deg. 42' 02" East, a distance of 55.01 feet to the existing Westerly standard highway easement line of Peck Road at 55.90 feet left of Station 15+98.53 where an iron pin set;

2. Thence along said existing Westerly standard highway easement line, South 01 deg. 05' 20" West, a distance of 28.89 feet to said existing Northerly standard highway easement line at 30.00 feet left of Station 15+85.73;

3. Thence along said existing Northerly standard easement line, South 64 deg. 47' 16" West, a distance of 35.73 feet to the point of beginning.

The above described parcel contains 0.011 acres (463 square feet, including 0.000 within the present road occupied), within Parcel Number 29-325-20-00-180-00C1), and subject to all legal highways and easements of record. This description was prepared by Arcadis U.S., Inc. under the supervision of Robert G. Hoy, Ohio Professional Surveyor No. 8142 and is based on a field survey performed by Arcadis U.S., Inc. 222 South Main Street, Suite 300, Akron, Ohio, 44308 in February 2012 under the direction of Samuel L. Stiltner, Ohio P.S. 8364. Bearings in this description are based on the Ohio State Plane Coordinate System, North Zone, NAD83 (CORS96).

Prior Instrument reference as of the date this survey was prepared: Volume 0113, Page 0398, Portage County, Ohio.

The stations referred are from the centerline of right-of-way of Newton Falls Road, as shown on the POR-14-12.55 plans.

Iron pin set is a 3/4 inch diameter, 30 inch long rebar with 1 1/2 inch diameter aluminum cap stamped "ODOT R/W Arcadius U.S. Inc."

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 6201 Peck Rd., Ravenna, OH 44266.

Said Premises Appraised at $125,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
