Bryan Eggleston aka Bryan E. Eggleston aka Bryan Eggelston, Eggleston's Unknown Heirs, Devisees, Legatees and Assigns, if any, et al.

In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, November 27, 2023, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, December 11, 2023 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Windham to-wit:

 

Situated in the Village of Windham, County of Portage, State of Ohio, being part of Original Lot 56 in said village and bounded and described as follows:

Beginning at monument box found at the Southeast corner of Original Lot 56, at the intersection of the centerline of Center Street and North Main Street; thence N. 00 deg. 19' 45" W., along the East line of Original Lot 56 and centerline of North Main Street, a distance of 1524.51 feet to a point at the Northeast corner of land now or formerly owned by T. E. Denvir (Vol. 1034, Pg. 552); thence S. 89 deg. 42' 40" W., along the North line of said Denvir, a distance of 33.00 feet to a 5/8" iron rod found in the West line of North Main Street; thence N. 00 deg. 19' 45" W., along the West line of North Main Street, a distance of 82.50 feet to a 5/8" iron rod set, which marks the true place of beginning for the following described parcel of land; thence S. 86 deg. 01' 50" W., a distance of 640.80 feet to a 5/8" iron rod set; thence N. 00 deg. 10' 35" W., a distance of 255.00 feet to a 5/8" iron rod set in the South line of land now or formerly owned by R. & D. Harman (2012 07155); thence S. 89 deg. 47' 33" E., along the Harman's said South line, the South line of another parcel of land now or formerly owned by Harman (2009 02515) and the South line of land now or formerly owned by Boulder Creek Ltd. Partnership (2006 13750), a distance of 638.85 feet to a 5/8" iron rod found in the West line of North Main Street; thence S. 00 deg. 19' 45" E., along the West line of North Main Street, a distance of 208.33 feet to the true place of beginning, containing 3.3990 acres of land, more or less, as surveyed and described July 12, 2012 by Rob A. Szuch, Registered Professional Surveyor No. 7288.

Said Premises Appraised at $145,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
