In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, October 30, 2023, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, November 13, 2023 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.
The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Atwater to-wit:

And known as being part of Lot No. 54 in said Atwater Township, bounded and described as follows:
On the North by land formerly owned by D. J. Welsh and Albert Kump, now owned by Dan Osco, L.D. & E. K. Freshley and L. D. & D. L. Haenftling; on the East, South and West by the East, South and West lines of said Lot No. 54, respectively, containing 54.83 acres of land, more or less.
Excepting therefrom the following described parcels of land:

Situated in the Township of Atwater, County of Portage and State of Ohio and known as being part of Lot No. 54, Atwater Township and being further described as follows:
Beginning at a steel corner post found set in concrete at the Southeast corner of Lot No. 54; thence S. 89 deg. 41' 50" W., a distance of 2249.99 feet along the South line of Lot No. 54 to an iron pipe set; thence North, a distance of 706.57 feet to an iron pipe set on the North line of P. Schultz 779/366; thence S. 89 deg. 55' 30" E., a distance of 2244.00 feet along the North line of P. Schultz to an iron pipe set on the East line of Lot No. 54; thence S. 0 deg. 28' 35" E., a distance of 692.47 feet along the East line of Lot No. 54 to the true place of beginning, containing 36.065 acres of land as surveyed by Terrence R. Hohnhorst, Reg. Land Surveyor No. 5065, August, 1967.
PARCEL TWO:
Situated in the Township of Atwater, County of Portage and State of Ohio and known as being part of Lot No. 54, Atwater Township, bounded and described as follows:
Beginning at the Southwest corner of lands in said lot formerly owned by F. W. Muratore, more recently owned by D. Osco, the said place of beginning being in the center of the North and South center road in said township; thence East along the South line of said Osco's land 36 rods; thence South 5 rods along the land now or recently owned by W. W. & I. S. Miller; thence West along another line of said Miller's land 36 rods to the center of said road; thence North along the centerline of said road 5 rods to the place of beginning, containing 1-1/8 acre, according to deeds, and according to Auditor's Tax Duplicate containing 1 1/2 acre.
Also excepting therefrom the following described real estate:
Situated in the Township of Atwater, County of Portage and State of Ohio, being part of Original Township Lot 54 of said township, and being part of a parcel of land now or formerly owned by Floyd B. Howiler per Image Number 200400952, 200400953 and 200400954 of the Portage County Records, and being more fully described as follows:
Beginning at a point at the Southwest corner of Lot 54 of Atwater Township, said point also being on the centerline of right of way of State Route 183 (60 feet wide), said point also being the Southwest corner of the Grantor, witness a 5/8" diameter rebar found with J. W. Daniel I.D. cap at S. 89 deg. 23' 44" E., 30.00 feet; thence N. 00 deg. 00' 00" E., 400.00 feet, along the West line of Lot 54, the centerline of right of way of State Route 183 and the West line of the Grantor, to a point, said point also being the true point of beginning for the following parcel herein described; thence continuing N. 00 deg. 00' 00" E., 229.48 feet, along the West line of Lot 54, the centerline of right of way of State Route 183 and the West line of the Grantor, to a point at the Grantor's Northwest corner, said point also being the Southwest corner of a parcel of land, now or formerly owned by Margaret B. Giller per Deed Volume 1162, Page 819 of the Portage County Records; thence S. 89 deg. 09' 19" E., 594.00 feet and passing over a 1 1/2" diameter iron pipe found at 30.00 feet along the North line of the Grantor and the South property line of the Giller parcel, to a mag nail found in the Southeast face of a 20" diameter oak tree at the Southeast corner of the Giller property; thence N. 00 deg. 00' 49" E., 82.50 feet, along the West line of the Grantor and the East line of the Giller property, to a 5/8" diameter rebar found with I.D. Cap 7256 on the Grantor's North property line; thence S. 89 deg. 07' 55" E., 533.80 feet, along the Grantor's North property line, to a 1/2" diameter iron pipe found at the Grantor's Northeast corner; thence S. 00 deg. 54' 29" W., 333.32 feet, along the Grantor's East property line, to a 5/8" diameter rebar found with I.D. Cap 7256; thence N. 89 deg. 43' 16" W., 276.77 feet, through the Grantor's parcel, to a rebar set; thence N. 89 deg. 51' 02" W., 207.41 feet, through the Grantor's property, to a rebar set; thence N. 86 deg. 42' 08" W., 639.28 feet, through the Grantor's property and passing over a rebar set at 609.23 feet, to the point of beginning and containing 7.397 acres of land, more or less, of which 0.158 acres of land, more or less, are contained within the current road right of way of State Route 183, as surveyed by Dan Stankavich, Professional Surveyor No. 7122, on July 30, 2005. Bearings for the above described parcel are assumed. All rebar set are 5/8" diameter x 30" long with I.D. Cap "Stankavich 7122".

Said Premises Appraised at $180,000.00 and cannot be sold for less than two-thirds of that amount.
TERMS OF SALE: CASHIER CHECKS ONLY
If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)
Deposit required by Third Party Purchasers are as follows:
If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).
Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).
Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)
The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)
The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.
The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
