In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, October 30, 2023, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, November 13, 2023 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Nelson to-wit:

Located in Lot 5, Nelson Township, Portage County, Ohio and bounded and described as follows:

Beginning at the intersection of the centerline of Ely Road (CH-288) and Ravenna-Parkman Road (SR-88); thence S. 5 deg 57' 50" W., along the centerline of SR-88, 1176.72 feet to a point of angle; thence S. 3 deg. 08' 50" W., along said centerline, 875.59 feet to a point, the Southwest corner of lands now owned by D. D. or B. A. Musgrove and the true point of beginning for the following described premises; thence S. 72 deg. 40' 12" E., passing over an existing iron pipe at 28.88 feet a total distance of 204.51 feet to an existing iron pipe; thence S. 56 deg. 27' E., 151.28 feet to an existing iron pipe; thence S. 25 deg. 30' 40" W., 294.13 feet to an iron pipe; thence N. 86 deg. 29' 30" W., passing over an iron pipe at 186.84 feet, a total distance of 219.86 feet to a point in the old centerline of Ravenna-Parkman Road; thence N. 8 deg. 57' 25" E., along said old centerline, 29.78 feet to a point of angle; thence N. 3 deg. 08' 50" E., along the present centerline of SR 88, 302.22 feet to a point; thence S. 86 deg. 51' 10" E., 40.00 feet to a point; thence N. 3 deg. 08' 50" E., 21.00 feet to a point; thence N. 86 deg. 51' 10" W., 40.00 feet to a point in the centerline of SR 88; thence N. 30 deg. 8' 50" E., along said centerline, 44.44 feet to the true place of beginning and containing 2.2590 acres of land as surveyed in November, 1995, by Donald D. Harvey, Registered Surveyor, #4112.

Said Premises Located at 12008 State Route 88, Garrettsville, OH 44231.

Said Premises Appraised at $235,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
