In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, April 10, 2023, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, April 24, 2023 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Kent to-wit:

And being part of Lot 30 in Franklin Township. Beginning for commencement at the Northeast corner of Sublot 209 of the Woodard Heights Allotment, Plat Book 4, Page 44 and witness an iron pipe found; thence South 87 deg. 22' 44" East along the South right-of-way of Longcoy Avenue, a distance of 500.10 feet to a point and the true place of beginning for the property herein described, witness an iron pipe found 0.35 feet East; thence continuing South 87 deg. 22' 44" East along the South right-of-way of Longcoy Avenue, a distance of 50.00 feet to a point, witness an iron pipe found 1.86 feet South and 0.39 feet East from said point; thence South 00 deg. 53' 43" West along the West line of J. V. Thompson Deed Volume 923, Page 795, a distance of 135.20 feet to an iron pipe found; thence turning North 86 deg. 25' 00" West along the North line of Woodard Heights Allotment, Plat Book 4, Page 44, a distance of 50.00 feet to an iron pipe found; thence turning North 00 deg. 52' 53" East along the East line of W. A. or S. F. Hershieser, Deed Volume 908, Page 265, a distance of 134.36 feet back to the true place of beginning. The area contained in this property is 0.1546 acres more or less. The basis of bearing is to an assumed meridian, and denotes angles only. The survey was performed by Terrence L. Pearson, P.S. #7305 in August of 2004. The property being conveyed is held in fee title by M. L. Waller, Deed Volume 753, Page 350. Said Premises Appraised at $130,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
