Bowers will take notice that the Defendant, Fifth Third Bank, National Association fka Fifth Third Bank, filed its Answer, Cross-Claim, and Counterclaim in the Court of Common Pleas, Portage County, Ohio, with the above reference case number. The object of and demand for relief in the Answer, Cross-Claim, and Counterclaim is to foreclose upon the Defendant’s Mortgage recorded upon the real estate described below and in which the Defendant alleges that the foregoing Defendant(s) have or claim to have an interest:

Beginning at a point that is the intersection of Cleveland Ave. also known as State Route 532, which point being the West line of Lot No. 47 also the West line of Portage County and the centerline of Etter Road, Township Highway No. 9-A, having a 60 foot right of way: Thence North 89 deg. 49 min. 26 sec. East along the center of Etter Road, a distance of 1200.63 feet to a point, said point being the easterly line of Orcholm Allotment No. 1 as recorded in the Portage County Record of Plats Book 11, page 33 and the true place of beginning; Thence North 89 deg. 49 min. 26 sec. East along said center of Etter Rd. a distance of 225.04 feet to a point: Thence South 13 deg. 50 min. 25 sec. East a distance of 402.80 feet and passing over a re-bar and cap set 34.35 feet from center of said road to a point; Thence South 14 deg. 11 min. 41 sec. Harvey, Registered surveyor No. 5454 in May of 1994.
