In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, February 13, 2023, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, February 27, 2023 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Atwater to-wit:

 

The following real property, situated in the County of Portage, in the State of Ohio and in the Township of Atwater and being a part of Lot 71 and also being part of a 7.003 acre parcel of land, now or formerly in the name of Marianne Davis as recorded in Volume 1017, Page 535 of the Portage County Records of Deeds, and more fully described as follows:

Commencing for reference at the centerline intersection of Moff Road (T.H. 51-B) (40 feet wide) and Edinburg-Alliance Road (S.R. 183) (60 feet wide), said intersection being the Southeast corner of Lot 71; thence N. 89 degrees 17 minutes 50 seconds W., along the centerline off Moff Road, and Southerly line of Lot 71, and passing over a 1/2 inch iron pin found at 30.00 feet, a distance of 1246.74 feet to a tract spike set at the true place of beginning of the parcel herein to be described; thence N. 89 degrees 17 minutes 50 seconds W., containing along the centerline of Moff Road and the Southerly line of Lot 71, a distance of 322.67 feet to a track spike set at the Southeasterly corner of a parcel of land, now or formerly in the name of Bearnhardt and Cora Hartig, as recorded in Volume 835, Page 70 (a 3/4 inch iron pin was found N. 89 degrees 17 minutes 50 seconds W., 242.05 feet); thence N. 00 degrees 30 minutes 49 seconds E., along the Easterly line of said Hartig Parcel, and passing over 1/2 inch iron pins found at 19.17 feet and 269.06 feet, a distance of 270.00 feet to a point on the Southerly line of a parcel of land now or formerly in the name of Arthur Graham and Irene Graham George as recorded in Volume 764, Page 667; thence S. 89 degrees 17 minutes 50 seconds E., along the Southerly line of said Graham and George Parcel, a distance of 322.67 feet to a 5/8 inch rebar with plastic I.D. cap set; thence S. 00 degrees 30 minutes 49 seconds W. and passing over a 5/8 inch rebar with plastic I.D. cap set at 250.00 feet, a distance of 270.00 feet to the place of beginning. Said parcel contains 2.000 acres of land, more or less, and is subject to all legal highways and easements of record, as surveyed in July of 1987, under the supervision of Robert A. Dorner, R.L.S. No. 6943 of Campbell and Associates, Inc.

The basis for bearings for this description is N. 89 degrees 17 minutes 50 seconds W. as the centerline of Moff Road and the Southerly line of Lot 71 and is the same as found on a map of survey dated November 1963, by Jere G. Medley, Reg. Professional Surveyor No. 4541.

Said Premises Appraised at $100,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
