In pursuance of an Order of Sale in the above entitled action, the sale will be conducted on the official public sheriff sale website, which is operated by Real Auction, http://Portage.Sheriffsaleauction.Ohio.gov. The process & procedures under which these sales will be completed are detailed at the Real Auction Website. The sale is scheduled for Monday, August 22, 2022, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, September 12, 2022 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Franklin to-wit:

 

All the following described premises, situated in the Township of Franklin, County of Portage and State of Ohio:

PARCEL 1:

Known as being Lots No. 110 and 111 in the Cressbrook Allotment, as shown on the recorded plat of said allotment in the records of Portage County Plat Book 5, Pages 1, 2, 3 and 4, said plat being made by H. S. Wagoner on July 21, 1920. Subject to restrictions and limitations or record.

PARCEL 2:

And being a strip of land 48 feet wide (North and South) and extending Easterly 110 feet off the South end of the following described property and being a parcel of land in said township Lot Number 10, bounded and described as follows:

Beginning at an iron pipe on the Easterly side of Cressbrook Allotment and the Southwest corner of land owned by Edward E. Leonard; thence North 0 degrees 181 East along the Easterly side of Cressbrook Allotment, a distance of 208.17 feet to an iron pipe; thence South 89 degrees 56 minutes East, a distance of 110.00 feet to an iron pipe; thence South 0 degrees 18 minutes West, a distance of 208.17 feet to an iron pipe on the Southerly line of Edward E. Leonard's property; thence South 89 degrees 56 minutes West along Leonard's Southerly line a distance of 110.00 feet to the place of beginning and containing 0.52568 acres of land more or less.

Being the same property conveyed to Nellie Mae Wright, by certificate of transfer from the Estate of Robert L. Wright, deceased, Case No. 2004ES530, dated January 10, 2005 and recorded January 10, 2005 as Instrument No. 200501690.

Being the same property conveyed to Robert Lee Wright and Nellie Mae Wright, by warranty deed from Italo Steiliano and Evangelina Siciliano, husband and wife, dated September 16, 1955 and recorded October 6, 1955 in Book 608, Page 263.

Said Premises Located at 481 S. Francis Street, Kent, OH 44240.

Said Premises Appraised at $150,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
