Vickers, whose last known address is 8792 Edison Street, Louisville, OH 44641 And The Unknown Spouse, Creditors, Executors, Executrices, Administrators, Heirs at Law, Next of Kin, Devisees, Legatees, and/or Assigns, and Their Spouses, Creditors, Executors, Executrices, Administrators, Heirs at Law, Next of Kin, Legatees, Devisees, and/or Assigns, if any, of Floyd B. Howiler, whose Identities and Addresses are Unknown, will take notice that on April 26, 2021, FIG as Custodian for FIG OH18, LLC, filed its Amended Answer, Counterclaim and Crossclaim in Case No. 2019 CV 00495alleging that the defendant(s), Bayview Loan Servicing, LLC, The Unknown Spouse, If Any, of Victor O. Vickers, aka, Victor D. Vickers And The Unknown Spouse, Creditors, Executors, Executrices, Administrators, Heirs at Law, Next of Kin, Devisees, Legatees, and/or Assigns, and Their Spouses, Creditors, Executors, Executrices, Administrators, Heirs at Law, Next of Kin, Legatees, Devisees, and/or Assigns, if any, of Floyd B. Howiler, have or claim to have an interest in the real estate described below:

 

Premises commonly known as 372 State Route 183, Atwater, OH 44201

Parcel No.: 01-012-00-00-013-001.

 

The Defendant, FIG as Custodian for FIG OH18, LLC, further alleges that by reason of default in the payment of the promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken and the same has become absolute.

The Defendant, FIG as Custodian for FIG OH18, LLC, demands that the defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshaling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Defendant, FIG as Custodian for FIG OH18, LLC's claim in the proper order of its priority and for such other and further relief as is just and equitable.

Said above named Defendants will further take notice that they are required to answer the Complaint on or before July 27, 2021.
