In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, November 27, 2017, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, December 11, 2017 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Ravenna to-wit:

 

Situated in the State of Ohio, County of Portage, City of Ravenna and described as follows:

Known as being part of Lot 64 S. D. in Ravenna Township and further described as follows:

Beginning at the centerline of Summit Road and Prospect Street, (formerly State Route 44); thence S. 89 deg. 40' W., 129.80 feet along the centerline of Summit Road; thence North 3 deg. 26' 30" West, 339.71 feet to an iron pipe in the Grantor's North line and passing over an iron pipe 33.00 feet from the road center; thence North 96 deg. 23' 30" East, 66.15 feet to an iron pipe at the Grantor's Northeast corner; thence S. 3 deg. 26' 30" East, 229.90 feet to an iron pipe; thence North 86 deg. 54' 30" East, 59.38 feet to the centerline of Prospect Street and passing over an iron pipe 33.05 feet from the road center; thence South 6 deg. 11' East, 110.00 feet along the centerline of Prospect Street to the beginning. Containing 0.665 or an acre of land, by the same more or less but subject to all legal highways, as surveyed in September, 1982 by David J. Collier, Registered Surveyor No. 4819.

Being a parcel of land lying on the left side of Prospect Street, C.H. 74. Beginning at a point at the intersection of the centerline of right-of-way of Prospect Street (variable width) and Summit Road, C.H. 148 (66 feet wide), said point being located at centerline Station 1110+00.00 of Prospect Street, witness a 1" diameter iron rod found in a monument box N. 87 deg. 32' 35" W., 34.48 feet, said point being the Southeast corner of the Grantor, said point also being the true point of beginning for the following parcel herein described; thence N. 87 deg. 32' 35" W., 129.80 feet, along the existing centerline of right-of-way of Summit Road and the Grantor's Southerly line, passing over a 1" diameter iron rod in a monument box at 34.48 feet, to a point at the Grantor's Southwest corner at Summit Road centerline Station 8+70.20; thence N. 02 deg. 20' 55" E., 33.00 feet, along the Grantor's West line, to a point on the existing Northerly right-of-way line of Summit Road, said point being located 33.00 feet left of Summit Road centerline Station 8+70.14; thence S. 87 deg. 32' 35" E., 78.26 feet, along the existing Northerly right-of-way line of Summit Road, to a rebar set, said rebar being located 50.00 feet left of Prospect Street centerline Station 1110+35.39; thence N. 10 deg. 02' 22" E., 77.71 feet, along the proposed Westerly right-of-way line of Prospect Street, to a rebar set on the Grantor's Northerly line, said rebar being located 36.14 feet left of Prospect Street centerline Station 1111+11.85; thence S. 87 deg. 17' 59" E., 36.19 feet, along the Grantor's Northerly line, to a point at that Grantor's Northeast corner, said point being located at Prospect Street centerline Station 1111+09.99; thence S. 00 deg. 14' 09" E., 109.99 feet, along the existing centerline of right-of-way of Prospect Street and the Grantor's East line, to the point of beginning and containing 0.174 acres of land, more or less, of which 0.156 acres of land, more or less, are present road occupied.

The above described area is contained within Portage County Auditor Parcel No. 29-364-00-00-007-001.

The above description was prepared by, or under the direct supervision of Dan Stankavich, Professional Surveyor No. 7122, on June 28, 2012 and is based on a survey performed by the URS Corporation in May through August, 2009, by or under the direct supervision of Dan Stankavich, Professional Surveyor No. 7122. Bearings are assumed and shown to denote angles only. All rebar set are 5/8" x 30" long with I.D. Cap "URS Corp". Subject to all legal highways, easements, conditions and restrictions of record.

Said Premises Appraised at $85,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
