In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, March 9, 2020, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, March 23, 2020 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.
The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Palmyra to-wit:
And known as being part of Lot 2, Division 1, Center and further described follows:
Beginning at an iron pipe at the Southeast corner of said Lot 2 Division 1, Center; thence West along the South line of said Lot 2, Division 1, Center and along the centerline of Tallmadge Rd. (C.H. 18, 132 foot R/W), a distance of 1378.97 feet to a point; thence North 00 deg. 34' 22" West, a distance of 66.00 feet to an iron pipe in the North R/W line of said Tallmadge Rd. and passing over an iron pipe at 33.00 feet; thence West along said North R/W line of Tallmadge Rd., a distance of 285.75 feet to an iron pipe at the true place of beginning; thence continue West along said North R/W line of Tallmadge Rd., a distance of 271.96 feet to an iron pipe; thence North 00 deg. 21' 00" East, a distance of 708.16 feet to an iron pipe; thence South 89 deg. 43' 38" East, a distance of 112.61 feet to an iron pipe; thence North 00 deg. 53' 22" East, a distance of 229.00 feet to an iron pipe; thence South 89 deg. 43' 38" East, a distance of 313.00 feet to an iron pipe; thence South 00 deg. 16' 53" West, a distance of 598.34 feet to an iron pipe; thence South 02 deg. 42' 50" East, a distance of 114.00 feet to an iron pipe; thence West, a distance of 163.98 feet to an iron pipe; thence South, a distance of 222.89 feet to the true place of beginning and containing 7.810 acres of land, be the same more or less, but subject to all legal highways and easement of record as surveyed by Dennis G. Heasley, Registered Surveyor No. S-5962, March, 1973.

Also transferring a 33 ft. strip of land directly South of the above with the East and West lines extended, which was vacated as Parcel #21 in the Vacation Plat of Tallmadge Road in Vol. 28, Page 38, of the Portage County Record of Plats and containing 0.206 acres of land, more or less.

Said Premises Located at 9237 Tallmadge Rd., Diamond, OH 44412.
Said Premises Appraised at $165,000.00 and cannot be sold for less than two-thirds of that amount.
TERMS OF SALE: CASHIER CHECKS ONLY
If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)
Deposit required by Third Party Purchasers are as follows:
If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).
Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).
Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)
The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)
The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.
The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
