In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, May 8, 2017, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, May 22, 2017 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

And being part of Original Lot 87 of said township, being also part of a parcel of land deeded to the Plough Revocable Living Trust per Deed Volume 1132, Page 344-346 of the Portage County Records and being further described as follows:

Beginning at a point at the intersection of the centerline of Hartville Road, C. H. 69 (60' wide) with the North line of Lot 87, witness a 1" diameter iron rod found in a monument box N. 36 deg. 20' 24" E., 1264.89 feet, at the centerline intersection of Hartville Road and Bassett Road, T.H. 44 (60 feet wide); thence S. 38 deg. 20' 24", 275.39 feet, along the centerline of Hartville Road, to a point, said point also being the true point of beginning for the parcel of land described; thence S. 87 deg. 31' 49" E., 1359.87 feet, through the Grantors property and passing over a 5/8" rebar set at 37.02 feet, to a 5/8" rebar set at the West line of a parcel of land deed to Robert R. and Kathleen J. Detwiller per Deed Volume 1161, Page 100 of the Portage County Records; thence S. 1 deg. 34' 32" W., 150.02 feet, along Detwiller's West line to a 5/8" rebar found with Cap No. 7122 at Detwiller's Southeast corner, said rebar also being on the North line of a parcel of land deeded to Gordon R. Jr. and Kay E. Lange per Deed Volume 1066, Page 76 of the Portage County Records; thence N. 87 deg. 31' 49" W., 1470.88 feet, along said Lange's North line and passing over a 1/2" iron pipe found at 1433.90 feet to a point on the centerline of Hartville Road; thence N. 38 deg. 20' 24" E., 185.11 feet along the centerline of Hartville Road, to the point of beginning and containing 4.874 acres of land, more or less, as surveyed by Dan Stankavich, Professional Surveyor No. 7122, in January of 1995.

Said Premises Located at 2434 Hartville Rd., Mogadore, OH 44260.

Said Premises Appraised at $275,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
