The Huntington National Bank, Plaintiff vs. Bill Marks, et al., Defendants.

The Unknown Heirs, Devisees, their Spouses and Creditors, Legatees and the Fiduciary of the Estate and Spouse and Creditors of Cynthia L. Covert, Deceased, whose last known addresses are unknown; Emily Covert, whose last known address is 3299 State Route 82, Mantua, OH 44255-9317; Unknown Spouse, if any, Emily Covert, whose last known address is 3299 State Route 82, Mantua, OH 44255-9317 and Unknown Spouse, if any, of Carrie L. Covert, Name Unknown, whose last known addresses are 19220 One Norma Blvd., Apt. B, Cornelius, NC 28031 and 972 Bridgwater Drive, Prescott, AZ 86301, each of you will take notice that on January 5, 2015, The Huntington National Bank filed its Complaint in Case No. 2015 CV 00009 in the Court of Common Pleas, Portage County, Ohio, alleging that there is due to the Plaintiff the sum of $249,957.72, plus accrued interest of $8,102.66, plus interest at 5.39% per annum from July 4, 2014, plus late charges and attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property, which has a street address of 3299 State Route 82, Mantua, OH 44255-9317, being Permanent Parcel Number: 23-020-00-00-004-000.

The Petitioner further alleges that by reason of default of the Defendants in the payment of a promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken, and the same has become absolute.

The Petitioner prays that the Defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Petitioner's claim in the proper order of its priority, and for such other and further relief as is just and equitable.

The Defendants named above are required to answer on or before May 29, 2015.
