In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C” in Ravenna, in the above named County, on Monday, March 25, 2019, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, April 8, 2019 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate is

 

Situated in the Township of Randolph, County of Portage and State of Ohio, recorded in Volume 1021, Pg. 0789 and being known as Lot 13 and further bounded and described as follows:

Beginning for reference at a monument found at the Northwest corner of a 15.353 acre tract of land now or formerly owned by Brady F. and Alberta Weich, said easement also being on the centerline from a monument found at the intersection of the centerline of Laubert Rd. (J.H. 29) and being 1710.05 feet Westerly along said centerline from a monument found at the intersection of the centerline of Laubert Rd. and along Weich's North line, a distance of 690.25 feet to a railroad spike set at the true place of beginning of the parcel herein described; thence continuing S. 88 deg. 24' E., along the centerline of Laubert Road, a distance of 174.4 feet to a railroad spike set at Weich's Northeast corner, said point being at the Northwest corner of a tract of land now or formerly owned by Rita Brown; thence S. 1 32' 40" W., along Brown's West line a distance of 1538.74 feet to an iron pin set on the South line of Lot 13, passing over a stone found 9.32 feet from the South lot line; thence N. 88 deg. 49' 30" E., a distance of 607.83 feet to an iron pin set; thence S. 88 deg. 24' E., a distance of 257 feet to all iron pin set; thence N. 1 deg. 44' 30" E., a distance of 934.21 feet to the place of beginning passing over an iron pin set 20 feet from the road centerline and containing 9.837 acres of land more or less. This description and a survey of this property was made by Donald L. Baird, Reg. Surveyor No. 4994, July 1976.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 4766 Laubert Rd, Atwater, OH 44201.

Said Premises Appraised at $60,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
